AN ORDINANCE AMENDING CHAPTER 5, ARTICLE 4, SECTION 5-4-3, OF THE HAWAII COUNTY CODE 1983 (2016 EDITION,AS AMENDED), RELATING TO INSTALLATION OF PHOTOVOLTAIC SYSTEMS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 5, article 4, section 5-4-3, of the Hawai`i County Code 1983 (2016 Edition, as amended), is amended by amending subsection (I)to read as follows: "(f) Installation of photovoltaic systems shall require: (1) Electrical design drawings and specifications that have been prepared, designed, and stamped by a person who is licensed in the State of Hawai`i as a professional electrical engineer for residential installations greater than 30 kilowatts and non-residential installations; and (2) Plans and specifications for building work that have been prepared, designed, and stamped by a person who is licensed in the State of Hawai`i as an architect or a professional structural engineer for: (A) Non-residential installations; or (B) Residential installations that do not utilize a preapproved system or that are not consistent with approved standards including but not limited to, those relating to span tables, older homes or site-built trusses." SECTION 2. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid.provision or application, and to this end the provisions of this ordinance are severable. SECTION 4. This ordinance shall take effect upon its approval.
