J�S1(0 N�1y <br />COUNTY OF HAWAII STATE OF HAWAII <br />9tE OF•NF'.� <br />RESOLUTION NO. 285 23 <br />A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE, AND NATURAL <br />RESOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO <br />KOHALA LIHIKAI. <br />WHEREAS, Section 10-15 of the Hawaii County Charter provides for a Public Access, <br />Open Space, and Natural Resources Preservation Fund to acquire lands and easements in the <br />County of Hawaii for public outdoor recreation, education, and preservation of coastal areas; <br />and <br />WHEREAS, Section 10-16 of the Hawaii County Charter establishes a Public Access, <br />Open Space, and Natural Resources Preservation Maintenance Fund (hereinafter "Maintenance <br />Fund") to preserve these lands, promote public safety, education, and maintain a healthy <br />stewardship; and <br />WHEREAS, Section 10-16(h) of the Hawaii County Charter provides that the <br />Maintenance Fund may be used for a stewardship grant program for properties purchased via the <br />Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 <br />nonprofit organizations to apply for grant-in-aid funding for stewardship projects; and <br />WHEREAS, Kohala Lihikai is a 501(c)3 nonprofit organization whose mission is to <br />protect access and open space in its natural state utilizing methods appropriate for each parcel <br />including cooperative agreements, easements, and acquisitions; and <br />WHEREAS, Kohala Lihikai has submitted a Maintenance Fund stewardship grant <br />application to continue providing land stewardship and cultural education for the Hdlawa (Hale <br />O Kd'ili) North Kohala property identified as tax map key (3) 5-3-007:022, as acquired via the <br />Public Access, Open Space, and Natural Resources Preservation Fund after adoption of <br />Resolution No. 327-15; and <br />WHEREAS, during its September 13, 2021, meeting, and pursuant to Section 2-217 of <br />the Hawaii County Code 1983 (2016 Edition, as amended), the Public Access, Open Space, and <br />Natural Resources Preservation Commission forwarded a positive recommendation for this <br />project to the Director of Finance; and <br />WHEREAS, Communication No. 1077, issued by the Director of Finance on October <br />14, 2022, submitted for the Council's consideration nine applicants for stewardship grants for <br />various properties that have been acquired by the County using the Public Access, Open Space, <br />and Natural Resources Preservation Fund; and <br />WHEREAS, in Communication No. 1077, the Director of Finance's recommendation is <br />that Kohala Lihikai will be able to complete its project in accordance with the project description <br />submitted and in strict adherence to the conditions governing the Maintenance Fund; and <br />
