Thank you for providing the public with an opportunity to learn more about the green debris recycling prograzns on island. Per your request, I have organized a list of issues, concerns and questions to help expedite the response time from the DPW representatives. Issue/Concern: Use of County labor and resources to provide hauling services for contracted vendor. Fact: County resources (laborers, operators, drivers, backhoe, trucks, and trailers) have been used since Oct. 1999 to load and haul green debris for a private vendor currently contracted to process green debris. Attachment A. Fact: Renew Hawaii, Inc. stationed aroll-off container in the area to accommodate small generators as specified in its scope of work detailed in previous proposal. Fact: Renew Hawaii, Inc. cleaned/maintained azea, loaded container with its own equipment and paid a local business for hauling services For entire contract duration. Question: What is the county's total cost incurred for providing mentioned services during the past five months? Labor hours, equipment use, truck & trailer use, etc.? Issue/Concern: Unfair RFP Application Fact: The site along with county provided resources and services were not included in the RFP. Attachment B. Fact: Responses to the RFP would have been influenced had the above conditions be specified in the RFP. County Provided Services The County shall provide the following services and facilities during the course of the contract. approximately one (1) acre site, cleared and grubbed, as is; see Attachments "A" and B". The Contractor shall visit the site and become familiar with the existing condition. Any improvements shall be detailed in the operations plan and be at the sole expense of the Contractor. • Compensate Contractor for green waste that is received from residential and commercial businesses. 4. Duration of Services The contract shall be effective for a period of one (1) year. The County reserves the right to renew this contract, solely at the option of the County, annually for two additional one-yeaz periods at unit prices to be negotiated with the Contractor, or Contractors if two sepazate contracts are issued. 5. Civil Service Laws It is understood and agreed that any service to be provided in accordance with the terms of this contract may be terminated immediately, in whole or in part, upon a finding by the County that the services must be provided by public employees pursuant to Civil Service laws or that such services will be discontinued. It is further understood and agreed that should such a finding be made, the County will not be liable under this contract for any resulting damages and such termination will not be considered a breach of this agreement. 6. Insurance: The Offerer is required to provide proof of insurance coverage naming the County as additional insured, for the duration of the agreement, in the following coverages and amounts: a. October 18, 1999 Mr. Robert Yanabu Hawaii County Dept. of Public Works 25 Aupuni Street Hilo, Hawaii 96720 Deaz Mr. Yanabu: I am writing to protest the awazd of the Green Waste Composting Pcogram For East Hawaii. My specific concern is the utilization of an area across from the transfer station gazbage chutes as a drop off site, without weighing. This location was not authorized or made available to other bidders in the RFP. Instead, the RFP described a 1-acre site next to the Hilo Landfill Scale House, as shown as "Attachment A" in the RFP solicitation. This may not appeaz as a significant deviation from the RFP to you, but last year, I was threatened with termination of my contract by Deputy Chief Jizo Sumada for using my site in the former Glover Quazry area. According to him, the designated site in the RFP was the requited site for drop offs, and I had to adjust my operations to comply. If patrons were to be allowed to drop off without weighing, I would have been required to amend the contract and provide a certified scale at my own expense. The present RFP does not have provisions for use of alternate sites other than the Scale House azea, nor does it allow for drop-offs without weighing. If the County would have allowed other bidders these concessions in the RF$ it would have signiEcandy influenced my proposal. As you know, the convenience to the public makes a substantial difference ¢t the success of the green waste program. Last yeaz's enforcement made it very inconvenient to the public, and the deviation from this year's RFP specifications gives a great advantage to one contractor over all others. This action, especially when compared to the enforcement of my contract last yeaz, appeazs to be azbitrary and capricious conduct. I will continue to operate my own green debris recycling and composting business. DEPARTMENT OF HEALTH PERMIT • RHI holds Permit by Rule No. CO-0064-96, to operate a low impact composting facility. • The State Department of Health -Office of Solid Waste Management sanctions the permit. • RHI may experiment with adding urea to material; allowable under the current permit • RHI's permit expires on 12/10/01. 7. I feel there aze several issues and concerns that need to be addressed and ask that you respond to the following items: 1. Justification of using county labor and resources to provide services for a private vendoz 2. Questionable RFP procedures. The main purpose of my call was to ask you why the county had been hauling green debris deposited neaz the gazbage chutes to another location farther away managed by HMR/Big Island Recycling. County workers (from the Solid Waste and Transportation divisions), backhoe, tandem dump truck and semi-trailer have all been used since last October to move green debris to HMR's site. County resources continue to be used to provide this vendor now contracted by the county. I feel there is a blatant contradiction when county labor and resources are used to provide a contracted vendor with a free service, not specified in the contract. Renew Hawaii, Inc. did not receive any similar service during a past contract where it proposed to provide small green waste generators with a convenient drop off location. You responded by saying that you aze working on amending the current contract so that the vendor would be responsible for hauling the green waste to the back. So what about the range of costs incurred during the 5-month interim? Why were there no measures taken to encourage the public to take material to the designated county site neaz scale house afrer acknowledging that this particular site was not specified in the RFP? (10/18/99 Correspondence) The RFP protocol used in this instance itself is questioned. The published RFP for the Green Waste Recycling Program failed to specify that there would be a county- designated public green waste drop off area based across from the gazbage trailers. RHI's proposal would have been influenced had this newly designated public drop off, in addition to the county-provided labor and resources been stated in the RFP. RHI was P.O. RHI proposed and was later contracted to maintain the front azea and did not "go on it's merry way" in accepting green debris up front as you described. If you reviewed RHI's past contract, it specifically included a designated azea for public- generated loads as the same service was offered during the most recent RFP. Did the current contracted vendor also propose to accommodate the public in this way or has the county twisted the RFP procedure to accommodate one vendor over others? Lastly, the issue of calling me a "hypocrite" is extremely disturbing. You clearly must have misunderstood my overall concern for calling you. It is not the "Renew Hawaii can collect green waste there but HMR cannot" syndrome as you accused me of. It is the unfair and selective treatment that prevails towazds one vendor over all others. It is truly unfortunate that a fair-leveled playing field had not been achieved from the beginning here where all players can compete equally and fairly. Your immediate response is requested.
