AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 5, SECTION 24-280, SCHEDULE 28, AND SECTION 24-281, SCHEDULE 29 OF THE HAWAI‘I COUNTY CODE 1983 (2016 EDITION), RELATING TO NO
PARKING AT ANYTIME UPON CERTAIN STREETS OR PORTION OF STREETS AND PARKING PROHIBITED DURING CERTAIN HOURS ON CERTAIN STREETS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I:
SECTION 1. The purpose of this ordinance is to: (1) prohibit parking alongside certain sections of Aliʻi Drive that front Kahaluʻu Beach Park; and (2) to designate certain sections
alongside Aliʻi Drive as public parking areas, during the hours of 5:00 a.m. to 8:00 p.m.
SECTION 2. Chapter 24, article 10, division 5, section 24-280, schedule 28, entitled “No parking at anytime,” subsection “(f) Kona,” of the Hawaiʻi County Code 1983 (2016 edition),
is amended by amending the following listings:
Aliʻi Drive, east (mauka) side, from a point five hundred eighty-one feet south of Mākoleʻā Street and extending [seventy-five] sixty-eight feet north of Mākoleʻā Street.
Ali‘i Drive, east (mauka) side, from a point three hundred [seven] nine feet north of Mākole‘ā Street and extending one thousand three hundred thirty-five feet north of Mākole‘ā Street.
Ali‘i Drive, west (makai) side, [for a distance of] from a point one hundred feet [on either side of each driveway into Kahalu‘u Beach Park.] south of Makoleʻa Street and extending six
hundred twenty-two feet north of Makoleʻa Street.
SECTION 3. Chapter 24, article 10, division 5, section 24-280, schedule 28, entitled “No parking at anytime,” subsection “(f) Kona,” of the Hawaiʻi County Code 1983 (2016 edition),
is amended by adding new listings to be appropriately inserted and to read as follows:
Aliʻi Drive, west (makai) side, from a point nine hundred thirty-six feet north of Makoleʻa Street and extending thirty-three feet in northerly direction.
Aliʻi Drive, west (makai) side, from a point seven hundred eighty-one feet north of Makoleʻa street and extending seventy-three feet in a northerly direction.
SECTION 4. Chapter 24, article 10, division 5, section 24-281, schedule 29, entitled “Parking prohibited during certain hours on certain streets; tow-away zone,” subsection “(f) Kona,”
of the Hawaiʻi County Code 1983 (2016 edition), is amended by adding new listings to be appropriately inserted and to read as follows:
Aliʻi Drive, east (mauka) side, from a point sixty-eight feet north of Makoleʻa Street and extending two hundred forty-one feet in a northerly direction from 8:00 p.m. to 5:00 a.m.
Aliʻi Drive, west (makai) side, from a point eight hundred fifty-four feet north of Makoleʻa Street and extending eighty-two feet in a northerly direction from 8:00 p.m. to 5:00 a.m.
Aliʻi Drive, west (makai) side, from a point five hundred twenty-two feet north of Makoleʻa Street and extending two hundred fifty-nine feet in a northerly direction from 8:00 p.m. to
5:00 a.m.
Aliʻi Drive, west (makai) side, from a point nine hundred sixty-nine feet north of Makoleʻa Street and extending one hundred forty-four feet in a northerly direction from 8:00 p.m. to
5:00 a.m.
SECTION 5. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material, and underscoring
need not be included.
SECTION 6. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions
or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.
SECTION 7. This ordinance shall take effect upon its approval.
