RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A
MULTI-YEAR AGREEMENT WITH THE FEDERAL HIGHWAY ADMINISTRATION AND/OR THE STATE OF HAWAI‘I DEPARTMENT OF TRANSPORTATION
WHEREAS, the County of Hawai‘i wishes to enter into a multi-year agreement for three (3) years with the Federal Highway Administration (FHWA) and/or the State of Hawai‘i Department of
Transportation; and
WHEREAS, this agreement is to receive federal funds for the County of Hawai‘i Safe Routes to School Program based on the financial obligation of matching funds by the County of Hawai‘i;
and
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more
than one fiscal year be approved by resolution; and
WHEREAS, Hawai‘i Revised Statutes, Section 46-7, requires that County departments obtain the consent of the council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant
to those powers; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I:
In accordance with section 46-7, Hawai‘i Revised Statutes and section 10-11 of the County Charter, the Mayor of the County of Hawai‘i is authorized to execute, on behalf of the County,
a three (3) year, multi-year agreement, and
related documents with the Federal Highway Administration and/or the State of Hawai‘i Department of Transportation to allow the County to receive grant funding as specified above.
That sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai‘i shall transmit copies of this resolution to the Office of Management, the Department of Public Works and the Department
of Finance.
