Re: VETO MESSAGE-BILL 198
Relating to Amendment to Capital Budget for Acquisition of Waiaha Bav Property
Pursuant to Section 3-12 of the Hawaii County Charter, I am disapproving Bill 198 and
returning it to you.
This bill amends Ordinance No. 99-71, the Capital Budget for the 1999-2000 Fiscal Year,
by adding a $1,000,000 for the acquisition of land for a Waiaha Bay Beach Park. It was
introduced and passed without requesting and considering the recommendations of the Mayor, as
is required by Section 10-6 of the Hawaii Caunty Charter. It also puts the acquisition of land in
the Capital Budget without sufficient resources available to the County.
If the Council seriously desires to acquire the land for the Waiaha Bay Beach Park, I am
enclosing a resolution which the Council may pass to authorize an eminent domain action for the
property. Upon passage of the resolution, we will initiate action to acquire the property. Upon
completion of a valuation, an appropriation bill will be forwarded to the Council to provide the
required funds. Rejection of the resolution will indicate that the Council is not seriously
contemplating the acquisition at this time.
