RE: Support for BILL 82: Relating to Maintenance of Private, Non -dedicated and Non -Surrendered Roads
The Hawaiian Acres Road Corporation held a monthly meeting on Saturday August 12, 2023 and discussed this
proposal for Road maintenance of private roads. An additional meeting was held today, on Saturday September
30, 2023
The HARC Board voted unanimously in Support of BILL 82.
Backround: Hawaiian Acres Road Corporation relies on voluntary road dues for road maintenance as our road
dues are not mandatory.
The Road lot TMK 16013081, lot # 6213 was registered with land court on 11/30/1990 but no deed was issued.
Later, when the Puna Emergency Access Road (PEAR) was constructed, a Warranty Deed was issued on
6/24/2003 to Nishimura Trust for $0.
All roads in Hawaiian Acres are open to the general public and necessary for public transportation so we are
requesting assistance from the County for maintenance of our connectivity roads.
Hawaiian Acres is a subdivision in Puna with connectivity to Fern Acres subdivision via Road 1 (Uhina Ana Road)
and Ainaloa subdivision via Road F (Ale Road). Both of these roads are used extensively for ingress and egress
and unfortunately both of these roads are in terrible shape. F road is mostly gravel and potholes.
Request for Assistance: Health and Safety Concerns
Hawaiian Acres would like pavement assistance for Road 1(Uhina Ana) and continue roughly 4 miles on Road 1
to Road F (Ale Rd). F Road would need assistance for 7 blocks (2-1/3 miles) from 1 Road to 8 Road (Moho Road).
Moho Road is part of the paved Emergency Access road which connects directly to Ainaloa Boulevard and lower
Puna.
Health and Safety are big issue for residents and users of 1 Road in Hawaiian Acres. The age of the one- lane of
pavement has many areas that are completely destroyed from years of flooding and excess traffic. In the past,
school buses have refused to travel on the broken pavement to pick up and drop off school children. Many of
the residents here would like a bus service/mass transit as was recently introduced to (8 Road) Moho Road.
Emergency Vehicles access and timeliness is another major concern. There are many senior citizens here with
serious health issues. Emergency vehicles: police, fire and ambulance services are very slow to respond to these
emergencies as the roads are in such disrepair.
Fire Risk, Lava Flow Risk and Accidents on Highway 130: Recently, there was a fatal accident on Highway 130
near the Keaau transfer station and traffic was diverted up Ainaloa Boulevard to 8 Road through Hawaiian Acres.
The road was gridlocked and our residents were unable to get out of our subdivision for 4-5 hours. Many folks
were unable to go to work that day and there were no police directing traffic. Our recommendation would
create another access road to upper Puna and highway 11. The risk of another Lava outbreak in lower Puna is
high and our proposal would allow residents another safe access road out.
The recent Lahaina fires have shown the necessity for a safe roadway out of our subdivision in case of a fire.
Right now, there is only 1 paved access is available, and nothing safely connects the upper road (1 Road) with 8
Road. We are asking for County assistance and support for the safety of our residents.
