PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTY SITUATED AT
WAIAHA BAY IN KAILUA-KONA AND IDENTIFIED AS TAX MAP KEY 7-5-18:20 FOR
THE PURPOSE OF A PUBLIC BEACH PARK.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`L
WHEREAS, the piece of land at Waiaha Bay in Kailua-Kona, also known as Honl's
Beach, is one of the last remaining white sand beaches in Hawaii, and is an area rich in natural
resources; and
WHEREAS, the County has few adequate beaches available for public recreation; and
WHEREAS, there is at present a Special Management Area Use Permit issued by the
Hawaii County Planning Commission for the Honl's Beach property that allows the construction
of a four-story, 21-unit condominium building that would impair the view of the ocean from Alii
Drive; and
WHEREAS, the Hawaii County General Plan Section 4(F), Natural Beauty Goals, states
that the County shall protect, preserve and enhance the quality of areas endowed with natural
beauty, including the quality of coastal resources; and
WHEREAS, the Hawaii County General Plan Section 4(K), Recreation Policies, states
that the County shall adopt an ongoing program of identification, designation, and acquisition of
areas with recreational resources such as land with sandy beaches and other prime areas for
shoreline recreation.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that it is necessary for the public use and purpose, to wit: the creation of Waiaha Bay
Beach Park as a public recreation area for the population of the County of Hawaii.
BE IT FURTHER RESOLVED that the Corporation Counsel of the County of Hawaii
be and is hereby authorized and empowered to initiate proceedings in eminent domain, as
provided by law, for the taking, acquisition and condemnation of the aforesaid private property.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to the Honorable Stephen K. Yamashiro, Mayor of the County
of Hawaii, the Department of Parks and Recreation, and the Office of the Corporation Counsel.
