Your Committee on Legislative Approvals and Acquisitions, to which was referred Bill No. 85, reports
as follows:
Bill No. 85, transmitted by Mayor Mitchell D. Roth, via Communication No. 518, dated September 20,
2023, amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning) of the Hawaii
County Code 1983 (2016 Edition, as Amended), by changing the District Classification from
Agricultural — 3 Acres (A-3 a) to Family Agricultural — 1 Acre (FA -1 a) at Hilo, Hawaii, covered by
Tax Map Key: 2-2-048:092.
The Windward Planning Commission forwards its favorable recommendation for this change of
zone request, which would allow the applicant to subdivide the property into two lots, each
approximately 1.4 acres in size to accommodate existing single-family dwellings. The property is
located at 605 Makalika Street, approximately 540 feet southeast (mauka) of its intersection with
Railroad Avenue.
Planning Consultant Daryn Arai appeared with Tyler Kaneshiro, son of the applicant, and gave a
brief overview of this project and explained that this zoning request is for estate planning purposes.
Planning Director Zendo Kern appeared and responded to several inquiries from the Council
Members. Mr. Kern explained that this request is consistent with the General Plan.
This bill was amended with the contents of Communication No. 518. 1, introduced by Council
Member Holeka Inaba, which added a five-year requirement to secure final subdivision approval.
Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent
of Bill No. 85, as amended to Draft 2, and recommends its passage on first reading.
