Transmitted herewith for Council approval is a revised resolution authorizing the County to enter into an agreement with the Department of Hawaiian Home Lands ("DHHL") to conduct maintenance and improvement work on County maintained roads located on Hawaiian home lands in Keaukaha. Per federal law, the County is responsible for the maintenance of roads located on Hawaiian home lands in Keaukaha. The DHHL is conducting sewer and water line work on roads located on Hawaiian home lands in Keaukaha ("sewer and water line project"). The Department of Public Works ("DPW") and DHHL have agreed to mutually contribute to the maintenance and improvement of said roads, upon completion of each phase of DHHL's sewer and water line project. The agreement states that DHHL will provide the funds for the maintenance and improvement of the roads, and DPW will provide the labor and equipment. DHHL is nearly finished with the sewer and water line work for phase one of the sewer and water line project; therefore, to expedite the execution of the road maintenance and improvement agreement, and the subsequent road work. DPW is requesting that this resolution be waived through committee and placed on the full Council agenda at the earliest possible time. Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of I Iawai'i, this written request is submitted with my approval that the above -referenced matter be waived from the Committee on Governments] Operations and External Affairs to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review. However, in the event this request is denied, for whatever reason. I understand the matter shall be referred to the Committee on Governmental Operations and External Affairs for placement on its future agenda.
