RE: Bill 84 HAWAII ISLAND CONTRACTORS' ASSOCIATION COMMENTS

Dear Chair Kimball, Vice Chair Inaba and Councilmembers,
My name is Dean Oshiro, President of the Hawaii Island Contractors Association. For 65 years,
we have represented the contractors and construction industry on Hawaii Island. We are
comprised of over 150 licensed general contractors, subcontractors and associate members. We
continue to advocate, support and educate our members and sustaining the construction industry
here on Hawaii Island.
The association has reviewed the draft Bill 84 and provides the following comments:
• Section 54-7 (a): The time for an applicant to obtain a permit within 180 days should
start from date application is accepted at intake rather than at date of submission.
• Section 5-4-7 (b): No permits are picked up anymore and are printed out by applicant
after permit is approved.
• Section 5-5-5 (a): What defines "substantially complete"?
• Section 5-5-5 (b): A provision that would help applicants would be to know:
0 1. Acknowledgement of extension request, date received by authority having
jurisdiction (AHJ)
0 2. Response date of AHJ, ex. "a decision will be sent within XX days of receipt'
o This would allow for the applicant to plan for their project timeline.
• Section 5-5-5 (c): while a 6 year expiration date of permits we appreciated, unforeseen
circumstances may occur where one 180 day extension may not be enough time. What
kind of flexibility will the applicant have if a second extension is needed?
