SUBJECT: Proposed Amendments to Bill No. 86; an Ordinance Amending Section 25-8-15
(t.ldmdkua District Zone Map), Article 8, Chapter 25 (Zoning) of the Hawaii
County Code 1983 (2016 Edition, as Amended), by Changing the District
Classification From Family Agricultural — 3 Acres (FA-3a) to Agricultural —
5 Acres (A-5a) at Waimea, Hdmdkua District, Hawaii, Covered by Tax Map
Key: 4-7-007:048.
Please see below proposed amendments to Bill No. 86. The proposed amendments are illustrated
in Ramseyer format with respect to the contents of Bill No. 86; material to be deleted is
bracketed and stricken, and material to be added is underscored.
SECTION 2 of Bill No. 86 is amended by amending Condition K and adding new Conditions L
and M to read as follows:
"K. [Should any of the eonditions not be met of substantially eomplied with in a timely

fashion, the Planning Dir-eetor- may initiate rezoning of the afea to its e6gifial or mefe
appr-epfiate designation.] Final Subdivision Approval for the proposed subdivision
shall be secured within ten (10) years from the effective date of this ordinance.
L. If the applicant fails to fulfill anv conditions of the zone chance within the s-oecified
time limitations, the Planning Director or County Council may initiate the process
for enactment of an ordinance reverting the affected property back to its original
zoning designation or a more appropriate zoning designation in accordance with
Section 25-2-43 of the Hawaii County Code.
M. An initial extension of time for the performance of conditions within this ordinance
may be requested in accordance with Section 25-2-44, subsections (e) and (d), of the
Hawaii County Code."
A draft copy of the bill, that would result if these proposed amendments are adopted, is not
