HomeMy WebLinkAboutRES 355 Draft 01 2022-2024A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE DEPARTMENT OF HAWAIIAN HOME LANDS REGARDING MAINTENANCE AND IMPROVEMENT OF COUNTY MAINTAINED
ROADS IN KEAUKAHA.
WHEREAS, Hawaiʻi Revised Statutes Section 46-7 requires the County of Hawai'i to obtain consent of the Council to enter into agreements with the federal or state governments, respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant
to those powers; and
WHEREAS, Section 220 of the Hawaiian Homes Commission Act mandates that roads running through or over Hawaiian home lands shall be maintained by the County in which the roads are located;
therefore, the County of Hawai'i is responsible for the maintenance of roads located on Hawaiian home lands in Keaukaha; and
WHEREAS, the Department of Public Works (“County”) and the Department of Hawaiian Home Lands (“DHHL”) desire to enter into a Memorandum of Agreement for paving, widening, and drainage
improvements for certain roads located in Keaukaha (“Project”); the Agreement requires DHHL to secure all necessary permits and approvals, and provide payment to the County for Project
materials, while the County will provide the necessary equipment and labor; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that in accordance with Hawaiʻi Revised Statutes Section 46-7, the Mayor of the County of Hawaiʻi is authorized to execute, on
behalf of the County, an intergovernmental agreement with the
Department of Hawaiian Home Lands for the maintenance and improvement of County maintained roads located on Hawaiian home lands in Keaukaha.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to 1) Mayor Mitchell D. Roth; 2) Deanna Sako, Director of Finance; 3) Stephen Pause, Director of
