Kimball, Member Absent and Excused: Ms. Cindy Evans, Member Mr. Holeka Goro Inaba, Member Ms. Rebecca Villegas, Member STATEMENTS FROM THP PUBLIC ON AGENDA ITEMS: BILLS FOR ORDINANCES: The Chair directed the Committee to proceed to the next order of business, Statements from the Public on Agenda Items. (There were none.) The Chair directed the Committee to proceed to the next order of business, Bills for Ordinances. Bill 95: AMENDS CHAPTER 24, ARTICLE 10, DIVISION 5, SECTION 24-280, SCHEDULE 28, OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION), RELATING TO NO PARKING AT ANYTIME UPON CERTAIN STREETS OR PORTIONS OF STREETS Adds a provision to prohibit parking alongside a section of Old Mdmalahoa Highway that fronts the De Luz Quarry adjacent to an exposed lava tube. Reference: Comm.543 Intr. by: Ms. Lee Loy (B/R) Motion to Close File: Ms. Kierkiewicz moved to recommend passage of Bill 95 on first reading. Seconded by Ms. Galimba. PCIA-5 October 31, 2023 CHR. LEE LOY: Members this is a matter that's being advanced by the Administration. I'm not sure if there's anyone here to testify, but I believe this is in your district, Ms. Kimball. Any comment? MS. KIMBALL: Nothing in detail, just supportive of the safety measure. So happy to support this moving forward. Thank you. CHR. LEE LOY: Ms. Kierkiewicz. MS. KIERKIEWICZ: Chair, motion to amend Bill 95 with the contents of Communication 543.7 Motion to Amend: Ms. Kierkiewicz moved to amend Bill 95 with the contents of Comm. 543.7. Seconded by Ms. Kagiwada. CHR. LEE LOY: Members, any comment on the amendment? If I could just help clarify, this is just a housekeeping matter. They mentioned an exhibit, and there was none attached so we're just cleaning it up for them. Point of Order: MR. KANEALI`I—KLEINFELDER: Point of Order. CHR. LEE LOY: Sure. MR. KANEALI`I—KLEINFELDER: Within the bill is Exhibit A, so it actually references the bill itself. MR. BROWN: If I may, Chair. I think what we're trying to do is, instead of having the exhibit and the map attached to the actual bill for the ordinance, that's not kind of normal standard procedure. We prefer it attached to the communication so that the bill for an ordinance can stand sort of separately by itself, so that's what we're doing. MR. KANEALI`I—KLEINFELDER: Thank you. CHR. KANEALI`I—KLEINFELDER: Yeah, thank you. Is anyone from the department here? Hey alright, can you come up please. I have some questions about this. Can you come up to the front and introduce yourself? What division are you with? Traffic Division. Press the button and then introduce yourself just for the record. (Note: At this time, Civil Engineer V Rizalino Mangaoang came forward to address the members of the Committee.) MR. MANGAOANG: Rizalino Mangaoang, DPW (Department of Public Works), Traffic Division. MR. KANEALI`I—KLEINFELDER: Good morning, Riz. How are you doing? MR. MANGAOANG: Good morning. MR. KANEALI`I—KLEINFELDER: My question is usually safety hazards exist. I'm looking over the document itself, but what is public safety hazard and the no parking going to prevent from happening? MR. MANGAOANG: The complaint that came by was the cars that are parked around this lava tube, which is around the blind turn. This is located at the De Luz Quarry. So when there's large vehicles, especially with trailers when people are trying to back out of it there's little response time because people are flying around the corner. And because there's a popular attraction there; people are walking, there's no shoulder, there's not enough width for people like a pedestrian walk way that people can safely get to it. So they're walking on the travel lane itself, and so that also kind of compounds. And as far as the safety hazard, that's the issue at hand. Page 3 PCIA-5 October 31, 2023 MR. KANEALI`I—KLEINFELDER: Okay, and this was brought forth by the Administration at the request of the folks from the Quarry? MR MANGAOANG: No, when we received this complaint there was somebody that submitted a request to our section. And so, we do an investigation. So I don't know if this is a resident or a commuter, but it's someone that realizes that there's a safety hazard there and submitted a complaint. MR. KANEALI`I—KLEINFELDER: Okay. Good to see us taking care of a public safety hazard. Thank you. Have you ever been to this tube before? No, me either. Okay. Thank you, Riz, appreciate it. I yield, Chair. Thank you. CHR.
