RE: Communication No. 657, Request to Waive Matter to the Council.
Dear Chairperson Chung:
Pursuant to Rule 4(e) of the Council Rules of Procedure, I respectfully request your permission
to have Communication No. 657, waived from hearing before your Committee on Finance to the
full Council. The reason for the request is that the bills for legal services in the William Silva, et
al., case have been outstanding since December of 1999. Because of the lack of funds in the
Special Counsel Account, we have been unable to pay the providers of those legal services since
December of 1999. I was informed in late December of 1999 that there were insufficient funds
in the Special Counsel Account to pay further invoices. By waiving the requirement for heazing
before your Committee on Finance, it will help expedite the process of paying these providers
and keep us current on expenses.

questions or concerns.

RE: Communication No. 657 (Bill 204), A bill for an ordinance amending the
Operating Budget by increasing revenues by $360,000 in the Fund Balance From
the Previous Year account in the General Fund and appropriating same to the
Corporation Counsel's special counsel and settlement expenditure account.
Pursuant to Section 1(e) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
