Kahawaiolaa, a native Hawaiian as defined, pursuant to the HHCA, 1920 as amended July 9, 1921, (42, 42 stat. 108) an the current President of the native Hawaiian homestead community, wherein 61 qualified native Hawaiians, on December 16, 1924 were awarded homestead leases on lands having the status of Hawaiian home lands, in Kuhio Settlement,which later became Keaukaha, Hawaiian Home Lands...for almost 100 years our kupuna and about five generations since the passing of the Federal Act, the Hawaiian Homes Commission Act, 1920, as amended, was ENACTED into LAW by the 67th Congress, 103 years ago... Some Historical background I'd like to share with you to put things into perspective... before there was an Hilo AirPort, 1929,there was a native Hawaiian Community of Keaukaha... The moolelo (the story) of Mamalahoe Kanawai ....The law of the Splintered Paddle...was established by a very young native Hawaiian who was "destined"to rule and unify these islands...when he became King...This law emphasizes the protection of human rights during the time of war and ensures safety for non combatants...This Law reflects a sense of Justice and Compassion in the Hawaiian Culture,the host culture that settle these lands 100 years ago. Now to today's subject matter... Bill 87...which seeks to Amend Sec 25-8-33 from Resort Hotel to Limited Indust laic.in 1 Comm. No. o� �y 1 Ref. Dote DEC --- Hotel resort zoning typically designates areas for hospitality and recreational purposes, allowing the construction and operation of hotels, resorts, and related amenities.The present zoning for TMK 2-1-006:002...the property involved for this bill is to CHANGE its Hotel Resort zoning to Limited Industrial use zoning which on the other hand...Limited industrial uses zoning, permits specific industrial activities but with restrictions on the extent and nature of those activities,while hotel resort zoning focuses on tourism and leisure, limited industrial uses zoning allows some industrial functions within defined parameters.The key distinction lies in the primary purpose and allowed activities within each zoning category. The subject property is DIRECTLY across what even this County identifies as a piece of the historical Ice Pond...which our moolelo(story)tells of a time it served as a natural refrigerator, with ice harvested from the nearby Mauna Kea, was stored in this pond for later uses...although this property sits at the gateway into what most people calls the Keaukaha Coast,to the very limited areas in Hilo where the people can recreate and spend time at the numerous beach parks along this coastline... beginning with the newest being Kuhio Kalanianaole park, Palekai, Keaukaha Beach Park(Puhi Bay),James Kealoha Beach Park,Carlsmith, Lalakea Lagoons, Wai'uli (Leleiwi beach park),Wai'oli (Richardson Ocean Center) and Lehia Park(Pumaile) end of road (Hilo's beach run)...the one way in and one way out road Kalanianaole Ave... Next to Ice Pond on the Banyan Peninsular which is also zoned Hotel Resort, is Reed's Bay,then Mokuola (Coconut island) is another park to recreate and Wailoa River then enters Hilo one(Hilo Bay)... The events of the April Fool's Day 1946, had and affect upon the people of Waiakea than the devastation of the 1960 Tsunami that completely inundate town and peninsular... and the subject property... and since then the Hotel Resort zoning was implemented at the behest of the people and county government to create conducive businesses that fits into the historical area that so the changes that made living in large communities in the area changed and businesses to catered to local people to be able to find places to eat,the proximity to hotels made the various restaurants within walking distance one could get 5 or 6 different types of food... This CHANGE of zoning also includes a service station... and that sends a red flag for me that the possible containment and pollution from the possible runoff from the service of vehicles into the Ice Pond....knowing full well that a service station ALREADY is in close proximity and another is unnecessary... I will end with the PROPOSED REDEVELOPMENT OF THE HILO HARBOR...which in my opinion will be a necessary evil... due to the fact 90% of our food and supplies comes to us by way of Shipping into Hilo Harbor...will tax our ability as a community to enjoy our homestead ... KEAUKAHA HAWAIIAN HOME LANDS IS ALREADY IMPACTED BY EVERYTHING THAT HAPPENS ON THIS SIDE OF THE ISLAND AND IN HAWAII COUNTY... THE AIRPORT,THE HARBORS,THE SEWER OUTFALL,THE GAS COMPANY,THE PETROLEUM COMPANIES, BIOFUEL, OF WHICH MANY LINES RUNS UNDER OUR ONLY ROAD IN AND OUT OF OUR COMMUNITY.:.HISTORICALLY, MUCH OF OUR LANDS HAVE BEEN USED BY GOVERNMENT TO BENEFIT THE GENERAL PUBLIC...
