Subject: Compliance with Conditions Tax Map Key: 6-2-2: 18, 19; Portions of 4 and 13 This is to acknowledge receipt of your letter dated December 17, 1999, regarding compliance with Conditions of SMA Use Permit No. 207 and Change of Zone Ordinance No. 84-45. The project, formerly The Bluffs, is referred to in our files as the Estates of Mauna Kea. According to SMA Use Permit No. 207, there are no relevant timetables to comply with. The effective date of the permit was based on the approval of the change of zone application, which was August 13, 1984. Applicable conditions have been complied with in Change of Zone Ordinance No. 84-45. Compliance with Condition B has been met with securing Final Subdivision Approval on December 5, 1984. Condition C required that construction be completed within three years of securing Final Plan Approval. According to our files, there is correspondence indicating that plans were submitted by letters on August 12 and August 13, 1985. Page 2 January iQ 2000 You have mentioned in your letter that Mauna Kea was not able to move ahead with the development due to changes in market demand. Should the environment change, it would be in order that revised plans be submitted for Final Plan Approval. Until such time, we shall consider that applicable conditions of both the SMA Use Permit No. 207 and Change of Zone Ordinance NO. 84-45 have been complied with. Based on these conversations and a review of materials pertaining to the permit, we believe that the applicant has complied with the conditions of SMA permit approval and that the permit remains in force. Condition A of SMA Permit No. 207 states: "The petitioner, successors or its assigns shall comply with all of the stated conditions attached to the accompanying change of zone." Condition B of the change of zone states: "The consolidation/resubdivision plan for the affected area shall be submitted for tentative approva! within ene (1) year from the effective date of the accompanying Special Management Area (SMA) Use Permit." The effective date of the SMA Use Permit was August 13, 1984. Our records show that final subdivision approval was granted on December 5, 1984. Condition C of the change of zone states: "Plans for plan approval shall be submitted for the proposed development within one year from the effective date of the accompanying Special Management Area (SMA) Use Permit." On behalf of Mauna Kea Properties, Inc., we submitted two sets of plans in compliance with this condition on August 12 and 13, 1985. Due to changes in market demand, Mauna Kea Properties was not able to move ahead with development of the property, and thus has yet to comply with this condition. There is current interest in the possible development of the property and we believe that Mauna Kea Properties, Inc. has to date complied with all applicable conditions of approval of both SMA Permit No. 207 and the accompanying change of zone.
