I still oppose hiring outside counsel but I have been looking into things more closely. The person for the job of
defending the County in the lawsuit is (drum roll...) is:
E. Britt Bailey - Litigation Division
Britt is a member of the Office of Corporation Counsel's Litigation Division.
Britt holds a bachelor's degree from Kenyon College, a master's degree in Environmental
Policy from Prescott College, and a Juris Doctorate from the William S. Richardson School of
Law at the University of Hawaii at Manoa, where she was a member of the Law Review. She
also earned a Certificate in Environmental Law through the William S. Richardson's School of
Law's Environmental Law Program.
Prior to joining the Office of the Corporation Counsel, Britt was a Deputy Prosecuting Attorney for the
County of Hawaii. In addition, she was a law clerk for Third Circuit Judge Ronald Ibarra. Prior to
attending law school, Britt worked with non-profit organizations in northern California
protecting both the health of the public and the environment from the effects of toxic
substances.
Britt is a member of the Hawaii State Bar Association and the West Hawaii Bar Association. She has
been licensed to practice law in Hawaii since 2012. In addition, she is admitted to practice before
the United States District Court for the District of Hawaii, United States Court of Appeals for
the Ninth Circuit and the Supreme Court of the United States.
Britt should be able to understand the science.

Holds a bachelor's degree from University of the Pacific, a bachelor's and a master's degree from
University of Oregon, practiced throughout the Willamette Valley, maintained a Schedule C farm 10
minutes south of Portland Oregon for five years, practice real estate sales in Hilo for 9 years (made
the Hawaii Business Magazines List of top ten bare land sales in the outer islands, built and runs a
county permitted family run bed and breakfast business subordinate to her family's residence for the

I am OPPOSED to RES 372-23, approving funds to hire outside counsel in HUI MALAMA HONOKOHAU, v. COUNTY OF

I recommend that our Corporation Counsel, Elizabeth Strance finds the time, and staff helps her to find the time to
represent the County. After all, Ms. Strance was appointed and confirmed based on just those abilities needed here:
Elizabeth A. Strance [she/her/hers] - Corporation Counsel
Ms. Strance is Corporation Counsel for the Office of Corporation Counsel.
She received her Bachelor of Science degree from Willamette University in Public Policy and
Political Science. She received her Juris Doctor from Northwestern School of Law of Lewis & Clark
College.
Prior to joining the Office of Corporation Counsel, Ms. Strance worked in the public and private
sectors. Her private practice work included alternative dispute resolution, litigation, and real
estate matters. Ms. Strance's public sector work was with the Hawaii Judiciary where she served
as a circuit court judge presiding over civil and criminal cases. Prior to her appointment to circuit
court, Ms. Strance served as a per diem judge where she presided in district and family courts.
Ms. Strance is a member of the Hawaii State Bar Association, and has been licensed to practice
law in Hawaii since 1988.
This lawsuit can be resolved through alternative dispute resolution. The County can ask and pay retired Judge
Ibarra to be the mediator. Our tax dollars should go to fixing the problem, not in-fighting.
