Aloha Honorable Council Members,
I am opposed to Resolution 372-23 and urge the Council to rejectany attempt by the administration to spend taxpayers
money fighting the lawsuit Hui Malama Honokohau v. County of Hawaii brought by citizens against the County. The
lawsuit clearly has merit and both the Mayor and Council are sworn to uphold the Public Trust Doctrine established in
our State Constitution. Failure to make reasonable attempts to resolve this problem will be a violation of your oath of
office to support and defend the Constitution and laws of Hawaii. I have attached a reference below explaining the
doctrine.
My understanding is that the County had a 60 day notice of intent to file and failed to attempt any negotiations. It is
clear that there has been significant neglect of our wastewater systems on the Island as evidence by the recent EPA's
actions against the County.
My recommendation is that the Mayor and Council work together to create a comprehensive plan of action to resolve
the wastewater issues plaguing our beautiful Island. First order of business is to reject this attempt to fight a legitimate
lawsuit and instead negotiate a settlement. Please vote no on Resolution 372-23.
