A RESOLUTION TO AMEND THE RULES OF PROCEDURE AND ORGANIZATION OF THE COUNCIL OF THE COUNTY OF HAWAI‘I BY AMENDING RULE NO. 23, BILLS AND RESOLUTIONS.
WHEREAS, the Rules of Procedure and Organization of the Council of the County of Hawai‘i (“the Rules”) govern the affairs of the Council of the County of Hawai‘i (“Council”); and
WHEREAS, the Rules were duly adopted as provided in Resolution No. 4-22 during the initial convening of the Council on December 5, 2022; and
WHEREAS, the Council seeks to improve the way it conducts its meetings by repealing Rule No. 23, Item No. 1(d), relating to the automatic postponement of bills and resolutions amended
at final reading, and renumbering any subsequent item(s) as required; the proposed amendment is illustrated below in Ramseyer format (material to be deleted is bracketed and stricken):
“[(d) A bill or resolution up for final reading that is amended on the floor shall not be acted upon at the time of the floor amendment. Final action on such an amended bill or resolution
shall not be taken until the next regular meeting. This provision shall not apply to:
The annual budget bill, pursuant to Article X of the Hawai‘i County Charter; and
The correction of manifest clerical or typographical errors in numbering, spelling, capitalization, punctuation, grammar and gender terms, provided that the correction does not alter
the meaning or effect of the underlying bill or resolution.]”
; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that Rule No. 23, Item No. 1(d), of the Rules of Procedure and Organization of the Council of the County of Hawaiʻi, relating to
the automatic postponement of bills and resolutions amended at final reading, is repealed as indicated above.
BE IT FINALLY RESOLVED that the County Clerk shall transmit replacement pages of the Rules that have been amended by the adoption of this resolution to all appropriate parties.
