SUBJECT: Resolution No. 372-23, Draft 2; Resolution Authorizing: (1) The Hiring of
Schlack Ito, a Limited Liability Law Company, as Special Counsel to Represent
the County of Hawaii in Hui Mal5ma Honokohau v. County of'Hawai'i, Civil
No. 1:23-CV-00393; and (2) The Payment of Funds of Later Fiscal Year and of
More Than One Fiscal Year for a Multi -Year Agreement with Special Counsel for
the County's Legal Defense in Hui Mal5ma Honokohau v. County ofHalvai'i,
Civil No. 1:23-CV-00393.
Attached is Resoluion No. 372-23, Draft 2. During its meeting on December 20, 2023, the
Council amended Resolution No. 372-23 by substitution per Communication 620.90, resulting in
this Draft 2.
The Council members voted to suspend Rule No. 23 -1 (d) of the Rule of Procurement and
Organization of the Council, which requires the holdover of a substantively amended resolution
and adopted Resolution No. 372-23, as amended to Draft 2.
