Home My WebLink AboutRES 409 Draft 01 2022-2024 ��SY OF N��•• • COUNTY OF HAWAII STATE OF HAWAII +ray'. ...••r•••'• rf OF MF/-' • RESOLUTION NO. 409 24 A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A QUITCLAIM OF REAL PROPERTY,BEING A PORTION OF GOVERNMENT HOMESTEAD ROAD AND A 30-FOOT-WIDE RIGHT OF WAY, SITUATE AT HONOMU, SOUTH HILO,ISLAND OF HAWAI`I, FROM THE STATE OF HAWAII, BY ITS BOARD OF LAND AND NATURAL RESOURCES WHEREAS,the State of Hawaii, through its Board of Land and Natural Resources, has agreed to quitclaim all of its right, title, and interest in and to a portion of Government Homestead Road and a 30-Foot-Wide Right of Way, situate at Honomu, South Hilo, Island of Hawai`i, as described in Exhibit "A" and delineated on Exhibit "B"; and WHEREAS, the Department of Public Works would like to clear up title issues related to the ownership of Government Homestead Road and a 30 Foot-Wide Right of Way that abuts the Hilo Forest Reserve in Honomu; and WHEREAS,acceptance of the above referenced quitclaim from the State of Hawaii will result in the County of Hawai`i having full and clear ownership over the above referenced portions of land, which will enable to the County to preserve and protect public access to the Hilo Forest Reserve; and • WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the Council may accept gifts and donations of real property on behalf of the County of Hawai`i; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I, in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, the County of Hawaii accepts the quitclaim of the real property described in Exhibit "A" and delineated on Exhibit "B". BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Honorable Mayor Mitch D Roth; (2) Finance Director Diane Nakagawa; (3) Director of Public Works Stephen Pause (4) State of Hawaii, Department of Land and Natural Resources, Division of State Parks; and (5) Deputy Corporation Counsel, Sinclair Salas-Ferguson.
