The Secretary's Minutes of the Executive Committee of December 16, 1999 were approved (Attached for information). The Treasurer's Report for the month of November 1999 was approved (Attached for information). Under Reports, it was reported that the Year 2000 HSAC Legislative Package was presented to both the Senate President and the Speaker of the House on January 14, 2000. Both leaders have accepted our package and agreed to assist HSAC in the introduction of all new measures. Speaker Say, however, did offer his reservations on HSAC proposals that attempted to reduce existing State revenues. Under NACo, members were advised of the pending events in March and May. It was reported that publicity and lobbying for WIR 2001 would likely begin in May. I[ was suggested that the promotion could include a free airline trip as par[ of the registration forms. President Mansho advised that NACo President Gray has announced the formation of a NACo Steering Subcommittee on Maritime and Ports. President Mansho has been named to chair this Subcommittee. It is hoped that this Subcommittee can lead to more Federal participation in the development of our port facilities. Under Unfinished Business, the Executive Committee continued its discussions on the 2000 HSAC Legislative Package. With respect to an HSAC supported proposal for tax credits for water conservation, i[ was noted that the Counties may want to look at the Farm Bureau's Bill which has a clearer definition of what constitutes a water conservation facility. While conceptually valid, the HSAC proposal may be misread to mean catchment water systems. With respect to the public service company tax, it was reported that if adopted, at least one utility (GTE) has indicated their willingness to pay [heir portion directly [o [he counties. Comm. Da JAN 2 0 2000 James Arakaki, Chairman January 20, 2000 Page 2 When the contents of the 2000 HSAC Legislative Package were being adopted by each of the counties, one of the measures relating to a change in the civil service laws relating to eligibles for police recruit vacancies, was deleted because it was believed by Maui County that the problem was a local one. It has since been determined that Maui is also having problems filling vacancies in its police force. It has been requested that Maui and Hawaii reconsider their position on this matter and authorize HSAC support of changes in the civil service laws relating to eligibles for police recruitment vacancies. (Copy of proposed bill attached, ACTION REQUESTED). For future Legislative Sessions, Council Member Swain, suggested that HSAC should also be given a time to present the positions of all four counties after the Counties make their presentations before the respective House and Senate Committees. Under New Business, the County of Maui submitted for consideration a proposal to invite and honor individuals who had a major role in the establishment or operation of HSAC to the next Annual Conference. 1 will be submitting the names of Helene Hale, Ikuo Hisaoka and Hiroshi (Scrub) Tanaka as possible nominees. REPORTS OF COMMITTEES A. Executive Committee Reports The following reports were received and placed on file: 1. From Secretary Nakamura reporting on the Executive . _ . - _ Committee's approval of the County of Kauai's request for an advanced payment to allow it to open its conference checking account. 2. From Secretary Nakamura reporting on the Executive Committee's approval of the 2000 HSAC Legislative Program Policy Statement 3. From Secretary Nakamura reporting on the Executive Committee's approval of Kenneth Mayfield to the position of NACo Second Vice President. B. County Reports There were no County Reports. C. NACo Reports Secretary Nakamura noted that NACo's legislative priorities would be finalized at the Legislative Conference in Washington D.C. and that the appropriate steering committee reports would be submitted prior to that conference. V. UNFINISHED BUSINESS - - Your Committee discussed each proposal included on its agenda for possible inclusion in the 2000 HSAC Legislative Package and obtained a unanimous position on the foAowing proposals: 1. Bill relating to hazardous recreational activities; 2. Bill relating to public land liability immunity; 3. Bill relating to abandoned vehicle disposal programs; 4. From NACo announcing the appointment of Ronald Kouchi to NACo's Environment, Energy and land Use Steering Committee. Your Committee also noted that Dennis Nakamura was appointed to NACo's Taxation and Finance Steering Committee and that Rene Mansho was appointed to NACo's Telecommunication Steering Committee as its Vice-Chair. VIII. ANNOUNCEMENTS A. President Mansho announced that the next meeting would be scheduled for January 19, 2000 in Honolulu. IV. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII: SECTION 1. Section 76-23, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows: "(b) Whenever there is a position to be filled, the appointing authority shall request the director of human resources development to submit a list of eligibles. The director shall thereupon certify a list of five or such fewer number as may be available, taken from eligible lists in the following order: first the promotional lists, second the recall lists, third the reemployment lists, and fourth the open-competitive lists; provided that laid-off regular employees shall be placed on an appropriate recall list; provided further that with respect to the eligibles under unskilled classes, the director shall certify all of the eligibles on such list. Where there is more Chan one vacant position in a class to be filled, the director may certify an additional eligible for each additional vacancy[.]• however for police recruits the director shall certify additional eligibles not to exceed five eligibles for each vacancy. The director shall submit eligibles in the order that they appear on the eligible list before applying veterans preference; provided that veterans whose examination scores, after addition of applicable preference, are equal to or exceed the examination score of the last eligible certified, shall also be certified; and further provided that if the last eligible to be certified is one of two or more eligibles who have identical examination scores, those -1- - OCT-21-1999 15 44 l,OUhlTY OF KRURf HGJ8 241 5319 P.02i'72 two or more eligibles shall be certified notwithstanding the fact that more than fzve persons aze thereby certified to fill a vacancy; and further provided that for each eligible without resident preference certified, a resident who has filed a resident income tax return within the State or who has been claimed as a dependent on a residentincome tax return, as provided by section 78-1, shall also be certified." SECTION 2. Statutory material to be repealed is bracketed. New statutory material is underscored. SECTION 3. This Act shall take effect upon its approval. -2- TOTR~ p.02 OCT-21-1999 15 92 COUPlTY OF KRURI B~78 241 6319 P.01i03 JUSTIFICATION SHEET PROPOSER: County of Kauai (For HSAC and County Legislative Packages) TTTLE: RELATING TO CIVIL SERVICE LAW PURPOSE: Allows the director to certify additional eligibles for police recruit vacancies. MEANS: Amends Chapter 76-23(b), Hawaii Revised Statutes. JUSTIFICATION: The Counties have found that the current number of eligibles is insufficient because of the high standards set for police recruits. Because recruiu are subjected to extensive screening processes, a higher than average number of eligibles are disqualified. Thus, the pool of eligibles must be expanded to ensure a sufficient number of qualified eligibles.
