SUBJECT: Bill No. 82, Draft 5; An Ordinance Amending Chapter 2, Article 9, Section 2-40
and Adding a New Article to Chapter 14 of the Hawaii County Code 1983 (2016
Edition, as amended), Relating to Improving, Grading, Repairing, or Construction
Work Upon Private, Nondedicated, and Non -Surrendered Roads.
Attached is Bill No. 82, Draft 5. During its meeting on January 10, 2024, the Council amended
Bill No. 82, Draft 4, with the contents of Communication 496.54, resulting in this Draft 5.
The Council voted to suspend Rule No. 23 -1 (d) of the Rule of the Procedure and Organization of
the Council, which requires the holdover of a substantively amended bill, and passed Bill No. 82
Draft 4, as amended to Draft 5, on second and final reading.
