COUNTY OF HAWAII • STATE OF HAWAII d �J BILL NO. 105 ORDINANCE NO. 24 4 AN ORDINANCE AMENDING CHAPTER 24,ARTICLE 10, DIVISION 5, SECTION 24- 280, SCHEDULE 28, AND SECTION 24-281, SCHEDULE 29 OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION,AS AMENDED),RELATING TO NO PARKING AT ANYTIME UPON CERTAIN STREETS OR PORTION OF STREETS AND PARKING PROHIBITED DURING CERTAIN HOURS ON CERTAIN STREETS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this ordinance is to: (1)prohibit parking alongside certain sections of Ali`i Drive that front Pahoehoe Beach Park; and(2)to designate certain sections alongside Ali`i Drive as public parking areas, during the hours of 5:00 a.m. to 8:00 p.m. SECTION 2. Chapter 24, article 10, division 5, section 24-280, schedule 28, entitled "No parking at anytime," subsection"(f) Kona," of the Hawai`i County Code 1983 (2016 edition), is amended by adding a new listing to be appropriately inserted and to read as follows: • Ali`i Drive, west(makai) side, from a point two thousand six feet north of La'aloa Avenue and extending twenty-eight feet in a northerly direction. SECTION 3. Chapter 24, article 10, division 5, section 24-281, schedule 29, entitled "Parking prohibited during certain hours on certain streets; tow-away zone," subsection"(f) Kona," of the Hawai`i County Code 1983 (2016 edition), is amended by adding new listings to be appropriately inserted and to read as follows: • Ali`i Drive, west (makai) side, from a point one thousand eight hundred twenty-six feet north of La'aloa Avenue and extending one hundred eighty feet in a northerly direction from 8:00 p.m. to 5:00 a.m. • Ali`i Drive, west(makai) side, from a point two thousand thirty-four feet north of La'aloa Avenue and extending two hundred twenty feet in a northerly direction from 8:00 p.m. to 5:00 a.m. SECTION 5. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 6. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 7. This ordinance shall take effect upon its approval.
