Subject: Testimony against Bill 121:

Dear Honorable Members of the Hawaii County Council, >1^
I am writing to express my strong opposition to Bill 121, which seeks to regulate haling—
platforms and transient accommodation rentals in Hawaii County. As a resident of Hawaii,
believe that this bill will have a detrimental impact on the private property rights of
homeowners and the local economy.
Firstly, Bill 121 erodes the fundamental right of homeowners to use their homes for
residential purposes, regardless of the length of tenancy or number of occupants. This is a
violation of the basic principles of property ownership and individual freedom.
Secondly, Bill 121 contradicts Hawaii Revised Statutes, which permit many uses of
residential property. It also ignores the recent Oahu ruling that maintained the 30-day
minimum for short-term rentals. This bill is not only unnecessary but also conflicts with
existing laws.
Thirdly, Bill 121 will not increase the availability of long-term or affordable housing, but rather
hurt the lower-income residents who rely on transient rentals for income and employment.
The excessive fines, fees, and reporting requirements imposed by the bill will further burden
the already struggling residents.
Lastly, the county has failed to enforce Ordinance 2018-114 (Bill 108), which was intended to
address the issues of illegal vacation rentals and community character. Instead of imposing
more regulations, the county should focus on enforcing the existing ones and finding a
balanced approach that respects the rights and needs of all residents.
Therefore, I urge you to reject Bill 121 and work towards a better solution that benefits the
community as a whole.
