Subject: Testimony against Bill 122,January 23, 2024 Policy Committee on Planning Land Use,
and Development
Aloha- I opposed the"sunsetting" of my 20 year old county permitted bed a.nd breakfast business
model. The grandfather clause should remain under principles of zoning estoppel.
I have forgone the three percent cap on my primary residence for twenty years under the County's
property tax scheme with the promise that my bed and breakfast use permit would stay with the land
under the zoning code. My property taxes were$10,000 last year. I have made significant investment in
off-street parking with room for cars to turn around and exit without backing out onto the roadway
screened from the street view, and becoming an online presence as a hosted bed and breakfast. Where
are the new rules for off-street parking for hosted TAR?
There is no definition for "hosted Transient Accommodation Rental" ("TAR") and no off-street parking
requirement for the same in Bill 122. The off-street parking requirements should be the same as the bed
and breakfast requirements.
