Aloha, My name is Cindy Freitas and I'm a Native Hawaiian descended of the native inhabitants of Hawai'i prior to 1778 and born and raised in Hawai'i. I am also a practitioner who still practice the cultural traditional customary practices that was instill in me by my grandparents at a young age from mauka (MOUNTAIN TO SEA) to makai in many areas. I'm OPPOSING BILL 107 (SECOND OR FINAL READING) for the following reasons: In 2009 County General Plan shows a proposed connection to Railroad Avenue by a future Puna mid- level collector. The Pana'ewa homestead community OPPOSED the connection of the mid-level connector to Railroad Avenue in the 2009 regional plan and reiterated their opposition in this regional plan update. (See First Amendment of U.S. Constitution and In re Pa Pelekane, 21 Haw. 175, 185 (1912); State v Jadwin, 85 S. W. 490-92 (Tex. Civ.App.) In 2016 the Final Pana'ewa Regional Plan. States that there are 200 to 3000 cars on a daily bases going thought Railroad Avenue.(see Pana'ewa Regional Plan chrome- extension://efai dnbmnnnibpcajpcglclefindmkaj/https://dhhl.hawaii.gov/wp- content/upl oads/2016/03/Draft-Panaewa-Regional-Pl an-Up date-Nov-2016-with-Track- Changes_11.02.16.p df) On March 15, 2022 Hawaiian Homes Commissioner has testify in OPPOSITION of HB 1403 HD1. With an adoption of DHHL Pana'ewa Regional Plan in 2016. In this plan utilization of Rail Road Avenue would unjustly burden Pana'ewa homestead lessees with additional traffic. The DHHL Regional plan did identify potential alternative routes that could alleviate trafficking coming into Hilo from Puna and avoid adverse impacts to Pana'ewa Homestead lessees. (See Chapter 673; Pana'ewa Regional Plan 2016) The surrounding land ownership and uses are major land uses in the vicinity that generate noise and pollution. The County solid wast facilities (landfill, transfer station, green waste) and a future Mass Transit Agency base yard lie to the east. An unencumbered DHHL, parcel lies between the County facilities and the ag. Homestead lots. The homestead and core commercial lots are beyond the threshold and airport noise contour. Two of the outlying large unencumbered lots are within the noise contour. The County drag strip borders one of the large unencumbered parcels designated for Residential homestead lots. Therefore Pana'ewa Homestead has been putting up with POLLUTION from County solid wast facilities and NOISE from County drag strip and also NOISE from State Airport in all do respect to HB C mm.t •�• Ref.To: Ref.Date tqA! 2 4 2D24 1403 HD1.
