Our councilwoman Ms.Sue Leeloy TRIED TO AMEND THIS BILL TO EXCLUDE ANY LAND HAVING THE STATUS OF HAWAIIAN HOME LANDS TO BE INCLUDED IN THE FINAL BILL...but too no avail 1.)The native Hawaiian lessees and beneficiaries at the hearing held on January 10, 2024, received a convoluted explanation as to why that kinds of language to EXEMPT OUR TRUST LANDS, could not happen because the way the House Bill 1403 was introduced as a funding mechanism...if any language was removed from or changed in any matter this HB 1403...would render the legislation moot, dead... As native Hawaiians when was these elected official going to come and seek the input from the native Hawaiian Communities of Keaukaha-Panaewa Farmers Association (KPFA), Panaewa Hawaiian Homes Lands Community Association(PHHLCA), and the Keaukaha Community Association(KCA)or our elected representative in councilwoman Ms.Sue Leeloy... 2) We're confused also...by the mere fact that the Chairman of the HAWAIIAN HOME COMMISSION, CHAIR KALI WATSON, submitted testimony asking that consideration be given that when the study is being done that our Trust lands be EXCLUDED FOR THIS STUDY... In my humble opinion the responses from the Corporation counsel Elizabeth Stance, when asked by Chair Kimball, was there going to be a problem with this testimony from the Commission Chair,whose language incorporated in our elected official's attempted amendment to Bill 107, was also confusing to the native Hawaiian lessees and beneficiaries...THEREFOREA POSTPONEMENT UNTIL JANUARY 24,2024,is where we're at So, may I be allowed to share WHY confusion abounds in the LEGISLATION SUBMITTED BY BOTH BODY POLITICO STATE HOUSE BILL 1403 AND COUNTY BILL 107... and it's possible affect on our Trust Lands(Railroad Ave)... Rep Ilagan and Chair Kimball FAILS to understand the tenants of the Hawaiian Homes Commission Act, .... CHAP 42...An Act To amend an Act entitled "An Act to provide a government for the Territory of Hawaii"approved April 30, 1900, as amended, to establish an Hawaiian Homes Commission"... 2 all of this happening during the Territory, than in 1959 An Act to provide for the Admission of the State of Hawaii into the Union,Act of March 18, 1959...(PUB L. 86-3, 73 stat. 4)... called the Admissions Act,Article XI, HAWAIIAN HOME LANDS, The Hawaiian Homes Commission Act...in part speaks to the encumbrances....which means in part... Encumbrances refer to any claims, liabilities, or restrictions on a property that may affect its transfer or use. This can include things like mortgages, liens, easements, or other legal restrictions. (ILLEGAL USE OF TRUST LANDS) "...§3 Compact with the United States, which states in part, ...and the encumbrances authorized to be placed on Hawaiian home lands by officers OTHER than those charged with the administration of said Act,SHALL NOT BE INCREASED, except with the consent of the United States; ..." CLEARLY FROM THE PROSPECTIVE of this native Hawaiian...Rep Ilagan, Council Chair Kimball...ARENOTOFFICERS CHARGED WITH THE ADMINISTRATION OF SAID ACT... That Power lays with the Chairman of the Hawaiian Homes Commission Kali Watson, who I think politely asked, by his Testimony dated 1/10/24 to the Chair of the Hawaii County Council... When and if the study associated with Bill 107, is conducted, that Hawaiian Home lands BE EXCLUDED...from the study So,the native Hawaiian Lessees and Beneficiaries will show up on the 24th of January to exercise our civic duty to again OBJECT TO BILL 107, reserving our rights also to peacefully protest in and around the County Building on Aupuni Street, sign wave along Railroad Ave...and failing that we will weigh our options pursuant to HRS Chapter 91, and other legal recourse and remedies to address what we believe to be a BREACH OF TRUST,for the continued ENCROACHMENT by the State and County,BY LEGISLATION, using Trust Lands for the General Public...
