Mahalo for entertaining this testimony opposing Bill 126 as written. =" ,
The stated intent appears to be in our best interests but the devil is in the details. This appears to be a eej€rk
reaction to the devastating Maui fire that will not yield the intended results.
1) - With the ease with which online private or public data sources become available to those with malicious
intent,this just presents another door for individuals to be maliciously targeted. Section 3 clearly relieves
the county of any responsibility/liability for the care and maintenance of this personal information.
2) Much of the information sought is already in the RE tax records, in the TAT applications, or otherwise
available in county records. If not,that presents a different problem. So this bill will simply require citizens
to provide private information that duplicates the same in other county sources contributing to multiplicity
of information abuse.
3) Given the income that may be derived by landlords particularly TAT,the maximum annual fine of$1,000 is
hardly an issue. We already have violators who ignore the legal provisions of this business to accept the
penalties as just a cost of doing business.
4) This information becomes useless in emergency situations when time is of the essence and leads to
severe increases in staffing to try get the"word"out fast and only when necessary. And if the internet,
email, phone systems, etc. are disabled then???
5) There appears to be no safeguard or penalty to those who ignore the provisions of this Bill. Given the wide
experience of the County's inability to enforce or even follow-up on complaints of clear violations this
simply becomes another law that few would abide by.
Better than a law that scofflaws will ignore and some will misuse as can, how about the county pulling this
information from a variety of sources already in county records?
