SUBJECT: Proposed Amendments to Bill 125; an Ordinance Amending Chapter 6 of the
Hawaii County Code 1983 (2016.Edition, as amended), by Adding a New Article
Relating to Commercial .Bicycle Tours.
Please see below proposed amendments to Bill No. 125. The proposed amendments are
illustrated in Ramseyer format with respect to the contents of Bill No. 125; material to be deleted
is bracketed and stricken; material to be added is underscored.
SECTION 2 of Bill No. 125, Section 6- . Definitions., is amended by amending the definition
of "Commercial bicycle tour" to read as follows:
"Commercial bicycle tour" means a [totir comprised of ^] group of persons traveling on
bicycles for the purposes of pleasure, [feereatio a ] adventure, or sightseeting rather
than for competitive sport or commuting and which is operated, conducted, organized,
facilitated, furnished with bicycles, or otherwise provided for by a business either as a
guided bicycle tour or unguided bicycle tour. ["Gammer-eiai oTeye-fe tout" shall include

SECTION 2 of Bill No. 125, Section 6- Prohibitions; penalties., is amended by amending
subsection (b) to read as follows:
"(b) [Any y business -espons b ! �^ ] The owner or agent of a commercial bicycle tour

that violates any provision of this article shall be subject to:
(1) A fine of $500 for the first offense; and
(2) A fine of not less than $1,000 per bicycle utilized in the commercial bicycle
tour [cofflffii++ r^ the el^* ^r r] during any subsequent offense."
A draft copy of the bill that would result if these proposed amendments are adopted, is not
attached due to the limited scope of these amendments.
