Re: Request for Executive Session for the Purpose of Discussing the Resolution
Authorizing the Employment of Special Counsel to Represent the County of
Hawai`i, Board of Ethics in Petition No. 2023-10
Dear Chairwoman Kimball and Hawai`i County Council Members:
Pursuant to Section 6-5.5, Hawai`i County Charter (2022 Edition),the Office of the ,
Corporation Counsel respectfully requests attorney-client confidential discussion in executive
session for the purpose of discussing with the Council the hiring of special counsel, in the
County of Hawai`i, Board of Ethics Petition No. 2023-10, as there is a real necessity for the
Office of the Corporation Counsel to recuse itself.
This request for executive session is also made pursuant to Hawai`i Revised Statutes §
92-5(a)(4), as we request attorney-client confidential discussion, in executive session,to consult
with the County Council on questions and issues pertaining to its powers, duties;privileges,
immunities, and liabilities regarding Board of Ethics Petition No. 2023-10.
I respectfully request that the aforementioned resolution be waived past committee
meetings and be placed on the Council's February 21, 2024 agenda.

RE: Resolution No. 440-24 •
A RESOLUTION AUTHORIZING THE
EMPLOYMENT OF SPECIAL COUNSEL TO REPRESENT THE COUNTY OF
HAWAII, BOARD OF ETHICS IN PETITION NO. 2023-10.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Governmental Operations and External Affairs to the full
Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter be placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, I understand the
matter shall be referred to the Committee on Governmental Operations and External Affairs for
placement on its future agenda.
