No. 441-24: A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN ADMINISTRATIVE ORDER ON CONSENT AGREEMENT WITH THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY PROCEEDING UNDER SECTION 309(a) OF THE CLEAN WATER ACT, 33 U.S.C. §1319(a). Date FE 2 ro ZU4 Governmental Operations and External Affairs Committee County of Hawai'i Department of Environmental Management Wastewater Administrative Order on Consent February 20, 2024 BACKGROUND Representatives from the EPA and DOH conducted a number of compliance inspections of the County wastewater facilities between 2016 and 2022. It was determined that the County: I. Does not have a program in place to systematically repair, rehabilitate, and replace aging infrastructure prior to failure; 2. Does not have capital improvement planning (CIP) program to evaluate criticality of infrastructure and to plan for anticipated failures; 3. Does not have an adequate financial plan with a sustainable funding mechanism to plan costs and financing for CIP projects and repairs; 4. Is not operating and maintaining its sewer collections systems to prevent sewage spills. 5. Has not sufficiently assessed the condition of its sewer systems; and 6. Does not have a program in place to systematically repair, rehabilitate, or replace its aging force mains prior to failure.
