RESOLUTION NO.
A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A QUITCLAIM OF REAL PROPERTY, DESCRIBED AS REMNANT ROAD RESERVE, PARCEL A, BEING A PORTION OF TMK NO. (3) 7-5-006-034 AND CONTAINING AN AREA
OF 1,794 SQUARE FEET, SITUATE AT LANIHAU 2ND, KAILUA, NORTH KONA, ISLAND OF HAWAI‘I, FROM THE STATE OF HAWAI‘I, BY ITS BOARD OF LAND AND NATURAL RESOURCES.
WHEREAS, the State of Hawai‘i, through its Board of Land and Natural Resources, has agreed to quitclaim all of its right, title, and interest in and to a Remnant Road Reserve, Parcel
A, containing an area of 1,794 square feet, situate at Lanihau 2nd, Kailua, North Kona, Island of Hawai‘i, as described in Exhibit “A" and delineated on Exhibit “B” (hereinafter “Parcel
A”); and
WHEREAS, acceptance of the above referenced quitclaim from the State of Hawai‘i will result in the County of Hawai‘i having full and clear ownership over Parcel A; and
WHEREAS, upon full acquisition of Parcel A, the Department of Public Works would like utilize Parcel A for public parking in Kona; and
WHEREAS, Article XIII, Section 13-12 of the Hawai‘i County Charter, provides that the Council may accept gifts and donations of real property on behalf of the County of Hawai‘i; now,
therefore,
NOW BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I, in accordance with Article XIII, Section 13-12 of the Hawai‘i County Charter, the County of Hawai‘i accepts the quitclaim
of the real property described in Exhibit “A” and delineated on Exhibit “B”.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Honorable Mayor Mitch D Roth; (2) Finance Director Diane Nakagawa; (3) Director of Public Works Stephen Pause
(4) State of Hawai‘i, Department of Land and Natural Resources, Division of State Parks; and (5) Deputy Corporation Counsel, Sinclair Salas-Ferguson.
