This bill provides necessary clarity and additional assurance that conditions of change of zoning district ordinances will be completed within a specific timeframe intended and provided by the county council, subject to the existing Hawai'i County Code Chapter 25. It is critical that a time certain be contained within each change of zoning district ordinance, not only to enhance and enable county planning, but because uncertainty is the bane of business investment. Bill 127 benefits the county government, its citizens, and property owners. Bill 127: 1. provides an additional incentives to fulfill change of zoning district conditions, such as affordable housing, 2. provides additional assurance that infrastructure improvements, such as roads, sidewalks, and sewer lines,will be completed in the time cited in the rezoning approval 3. avoids undermining future decisions on budgets, infrastructure, and other rezonings which may have been made under the assumption that conditions, such as infrastructure, for the change of zoning district would have been completed, 4. increases the ability of the county council to make appropriate updates to conditions of change of zoning district ordinances as a result of unanticipated events, such as new flood . zones and tsunami zones caused by climate change requiring new evacuation routes.
