SUBJECT: Proposed Amendment to Bill No. 134: an Ordinance Amending Chapter 25,
Article 2, Section 25-2-42 of the Hawaii County Code 1983 (2016 Edition, as
Amended), Relating to Amendments Initiated by Property Owners and Other
Persons.
Transmitted herewith is a proposed amendment to Bill No. 134. The proposed amendment is
shown below in Ramseyer format with respect to the contents of Bill No. 134; material to be
deleted is bracketed and stricken; material to be inserted is underscored. A copy of the new draft
of this bill that would result if this proposed amendment were adopted is intentionally omitted
due to the limited scope of the amendment.
SECTION 1 of Bill No. 134, which amends chapter 25, article 2, section 25-2-42 of the Hawaii
County Code 1983 (2016 Edition, as amended), is amended by amending subsection (c),
paragraph (4) to read as follows:
"(4) The director shall prepare a report identifying all buildings, excluding existing
buildings, that are legally permitted to be constructed on surrounding properties of
which any portion is within [one thousand thfee hundfed and twenty root f the

commission and the council prior to their respective consideration of the change of
zone sought by the application."
