SUBJECT: Resolution No. 441-24: A Resolution authorizing the Mayor to enter into an
Administrative Order on Consent agreement with the United States
Environmental Protection Agency proceeding under Section 309(a) of the Clean
Water Act, 33 U.S.C. § 1319(a).
For your information, an error in the timeline has been identified in Appendix I of the
Administrative Order on Consent (AOC) and the U.S. Environmental Protection Agency has
proposed a correction.
The proposed correction, presented below in Ramseyer format, changes the invitation for bid
deadline to a weekday, and clarifies that it will precede the start of construction.
The final AOC is proposed to reflect this change to Appendix 1, Section 1, Paragraph 7, which
will read as follows (emphases in the original):
"T Pua SPS Force Main: By December [2-9] 31, 2030, the COH shall issue an invitation for
bid for the construction proposal for the project. By [july 1, 2030] December 31, 2031
the COH shall begin construction on the project, except that after having identified a
construction contractor (but prior to [Judy-1, 2030] December 31, 2031), the COH may
submit a construction schedule to EPA and DOH for approval of a different construction
start date. By June 30, 2035, the COH shall complete rehabilitation of the existing force
main."
