SUBJECT: Transmitting Resolution No. 441-24, Draft 2: A Resolution authorizing
the Mayor to enter into an Administrative Order on Consent agreement
with the United States Environmental Protection Agency proceeding under
Section 309(a) of the Clean Water Act, 33 U.S.C.§1319(a).
Transmitted herewith is Resolution No. 441-24, Draft 2. Resolution No. 441-24 was amended
with the contents of Communication No. 732.4, as duly approved by the Council during its
meeting on March 6, 2024.
The Council voted to suspend Rule No. 23-1(d) of the Rules of Procedure and Organization of
the Council of the County of Hawai`i, which requires the holdover of a substantively amended
resolution, and then adopted Resolution No. 441-24, as amended to Draft 2.
