OF N, •' <br /> COUNTY OF HAWAI`I 4`'_ '':•j STATE OF HAWAI`I <br /> qTE . <br /> BILL NO. 143 <br /> ORDINANCE NO. <br /> AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE III, SECTION 3-2, <br /> OF THE HAWAI`I COUNTY CHARTER(2022 EDITION), RELATING TO COUNTY <br /> COUNCIL TERMS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: <br /> SECTION 1. Article III, section 3-2, of the Hawai`i County Charter (2022 Edition), is <br /> amended to read as follows: <br /> "Section 3-2. Composition and Terms. <br /> There shall be a county council composed of nine members. There shall be nine <br /> council districts, each of which shall be represented by a resident elected from that <br /> district. The terms of the council members shall be [two] four years and shall begin at <br /> twelve o'clock meridian on the first Monday of December after their election. The terms <br /> of the council members shall not exceed [feu] three consecutive [two] four-year terms. <br /> Candidates shall be elected in accordance with the election laws of the state, insofar as <br /> applicable." <br /> SECTION 2. Any incumbent council member reelected in the 2024 election, either in <br /> the first special election or second special election, shall serve a four-year term and may run for <br /> two additional four-year terms, consecutively,regardless of the number of terms served as the <br /> incumbent council member. <br /> SECTION 3. Charter material to be repealed is bracketed and stricken.New material is <br /> underscored. When revising, compiling, or printing these charter provisions for inclusion in the <br /> Charter of the County of Hawai`i, the reviser need not include the brackets, bracketed and <br /> stricken material, and underscoring. <br /> SECTION 4. Severability. If any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end the provisions of this ordinance are severable. <br />
