Arakaki Hawaii County Council 25 Aupuni Street Hilo, HI 96720 Dear Chairman Arakaki: Re: Bill No. 204, as amended (Second Readinel As we recall, the Council unanimously agreed to settle the amalgam of wrongful death and injury cases, i.e., Perreira, Fergerstrom, Tavares, Rowe & Paiva v. County of Hawaii, et al., Civil Nos. 98-83 through 98-87 (consolidated)("Kolekole"), for a total of $375,000. In our view, evidently shared by the Council, it would have been grossly fiscally irresponsible to decline to settle these cases which had a prognosticated jury value of from $6,000,000 to $8,000,000 with County aliquot responsibility pegged per the most conservative knowledgeable opinions elicited at not less than 10% thereof. That being so, it appears to be salutary and appropriate to facilitate prompt and lawful payment of these obligations by augmenting the sum transferred per Bill No. 204, by the additional sum of $375,000, as reflected in the proposed amended bill up for second reading. To that end, a copy of the proposed bill, as amended, is enclosed. For your information, the precise sums due the plaintiffs are as follows: 1. $197,362.50 to Heather L. Fergerstrom (Civil No. 98-84). 2. $49,350.00 to Crudele, De Lima and Shiroma (Civil No. 98-83). 3. $128,287.50 to Ian Mattock, Attorney, (Civil Nos. 98-85, 98-86, 98-87).
