COUNTY OF HAWAI`I <br />STATE OF HAWAI`I <br />RESOLUTION NO, 499 24 <br />RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH THE STATE OF HAWAN DEPARTMENT OF <br />DEFENSE HAWAI`I EMERGENCY MANAGEMENT AGENCY <br />WHEREAS, the Hawai'i County Civil Defense Agency ("HCCDA") desires to <br />enter into a license agreement with the State of Hawai'i Department of Defense <br />Hawai'I Emergency Management Agency ("HIEMA"); and <br />WHEREAS, this agreement is to support and facilitate the installation and <br />maintenance of a warning siren within the County of Hawaii Kamakoa Nui Park to <br />serve the Kamakoa Phase I -A Subdivision region in the Waikoloa area; and <br />WHEREAS, this siren would serve a gap area that currently does not hear <br />a siren for emergency management purposes; and <br />WHEREAS, the license agreement would not require the payment of any <br />County of Hawai'i funds nor would it utilize any federal funds; and <br />WHEREAS, Hawai'i Revised Statutes, Section 46-7, requires that County <br />departments obtain the consent of the council to enter into agreements with the <br />federal or state governments respecting action to be taken pursuant to any of the <br />powers granted by law to furnish, expend, and receive any funds or other <br />assistance in connection with projects being or to be undertaken pursuant to those <br />powers; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I, in <br />accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the <br />
