RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAI‘I DEPARTMENT OF DEFENSE HAWAI‘I EMERGENCY MANAGEMENT AGENCY
WHEREAS, the Hawai‘i County Civil Defense Agency (“HCCDA”) desires to enter into a license agreement with the State of Hawai‘i Department of Defense Hawai‘i Emergency Management Agency
("HIEMA"); and
WHEREAS, this agreement is to support and facilitate the installation and maintenance of a warning siren within the County of Hawai‘i Kamakoa Nui Park to serve the Kamakoa Phase I-A
Subdivision region in the Waikoloa area; and
WHEREAS, this siren would serve a gap area that currently does not hear a siren for emergency management purposes; and
WHEREAS, the license agreement would not require the payment of any County of Hawai‘i funds nor would it utilize any federal funds; and
WHEREAS, Hawai‘i Revised Statutes, Section 46-7, requires that County departments obtain the consent of the council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant
to those powers; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I, in accordance with section 46-7, Hawai‘i Revised Statutes, that the Mayor of the
County of Hawai‘i is authorized to execute, on behalf of the County, an agreement and related documents with the State of Hawai‘i Department of Defense Hawai‘i Emergency Management Agency
as indicated above.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai‘i shall transmit copies of this resolution to the Office of Management, the Finance Department, and the Civil Defense
Agency.
