County Reports: i. County of Hawai`i CM Kimball: Sent out email with description of two classes provided by Texas A&M service training institute, courses fully funded by FEMA. Specific for elected leadership, appointed leadership. Attended the P1O training, and highly recommend bringing these programs to your county. Hawaii county doing it in May. Training can be for all council members and administrative staff Legislative update: bill to amend permit expiration date for building permits, 6 years, no micromanagement, no extensions, should be tied with interval for expecting state to move forward with building code adoptions. Looking at legislation for a clean water fee based on those not converting, based on those not converting. Funds to go into a revolving fund that would help lower income connect to a sewer. Working on draft language. Working with Speaker Saiki on re-designation on areas that are agriculture to rural, changing an aggregate of one acre to state land use to rural. Would allow ADU's to be built on their lots. ii. County of Kaua`i CM Carvalho: Passed 2906 to establish constituent staff support positions for 4 of 7 members. discussing bill 2910 relating to recovery of rescue expenses, HRS Chap 137 reimbursement act. Working on search and rescue wildlife donations fund, with the county council. Discussing charter amendment to revise board of water supply, out of 4 members, at least one should have awareness of Hawaiian culture and environmental concerns. County of Kauai waiting for two outstanding items from the conference,formal report coming and bank documents to be handed over when complete. CM Cowden: General discussion on how wildfire management is a big concern, fire management is a big deal. Committee of public safety is eager to work on this. iii. County of Maui CM Paltin: Passed the debris removal bill, cannot the toxic remains to the landfill. Two options, one is the government and the other is the alternative program then the responsible fines and penalties apply. Need t o choose a program at least one month after the last zone of re-entering is open. Mahalo to Hawaii County for loaning Darryl to run EOC. Nov 1 Kula begins assessment of removing debris. Nov 1 is full opening for tourism in West Maui. Concern over lack of infrastructure. 134 eateries existed in Lahaina. Have not yet sampled the ash at Lahaina but the ash at Kula has dangerous components. Passed a resolution to cancel and re-bid the emergency medical response on Kauai and Maui, Will re-bid the service on Maui, request is to re-bid the service together with air and on the ground. There was no medivac in the contract before. Passed bill about extra charges for outside hours, used for fireworks, did not want to pay the cost of this. Have 7-8,000 displaced people in temporary housing. Talk within the community to stop the allowance of short term rentals to help support the displaced people. Looking at the October 26, 2023, HSAC Meeting Minutes Page 13 "s9�,, SAS. 4 oRfo=N"�i budget which is already down $34 million, looking at short term rentals or hotels to house the residents. Concerns in the community about re-opening to tourism, concerns about the safety of the schools. The initial tents at the elementary school were clocked at over 90 degrees, generators are loud, temperatures are high and there is high concern over safety of the kids returning to school. Majority of the immersion programs are not going back and when they do go back the only option is distance learning in english. EPA expects to finish phase 1 shortly after thanksgiving. Phase 1.55 is when people get to re-enter and visit their properties. Phase 2 army corp of engineers can come in. Further discussion about the areas that have displaced people and where they are and where they anticipate moving to. iv. City and County of Honolulu CM Waters: Next HSAC conference scheduled for 18-20 of September. Looping at various locations. Discussion on if there is a preference. v.NACo Report CM Waters:Reminder about the NACo conference Feb 10-13, Washington Hilton. Friday, Feb 9, session called FEMA, which would be helpful. CM Carvlaho:NACo report received. c. WIR Report d. Executive Director Report ED report: ED currently in Asheville attending the Executive Directors conference. Developed financial plans, conference guidebook, corporate partnership program. The next step is to share these with the HSAC ED via email and have everyone weigh in. Focus is on three goals,fundraising, legislative,federal and national relationships. Upcoming: DC breakfast upcoming to invite local vendors to showcase their products. Will be doing a budget review, analyzing where we are at in comparison to what has been spent versus what was budgeted. In addition, the question that needs to be looked into is if we need to be a 501(c)(3) or 501(c)(6). Finally, the corporate sponsor program that can be built out, requires time to build out the website with more content. Need to do an analysis of past sponsors at each conference. Includes review of who sponsored who supported each year, categorize each one. e. Legislative Report Jon Okudara: Sent a discussion on proposals received from Hawaii county and Maui county. V. UNFINISHED BUSINESS VI. NEW BUSINESS a. Communication (09/29/2023) from Graham Knaus, CEO of California State Association of Counties, transmitting information regarding California Peer-to-Peer Support Network. Maui County Resolution No. 23-175 APPROVING FOR INCLUSION IN THE 2024 HAWAI`I STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE A STATE BILL RELATING TO THE MINIMUM WAGE. CM Paltin: Aye, cost of living and vacancies and prices of rentals. Near impossible to fill county positions. Need for more support. This measure has not been approved to be included in the HSAC legislative package. ii. Maui County Resolution No. 23-176 APPROVING FOR INCLUSION IN THE 2024 HAWAI`I STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE A STATE BILL TO ESTABLISH PAID FAMILY LEAVE FOR STATE AND COUNTY EMPLOYEES. Jon Okudara: Any leave of absence is covered under collective bargaining. Can this be mandated or is it a negotiable item. CM Kimball: Supportive but had not considered the collective bargaining aspect. Can we support paid family leave in general if not coming from HSAC. Jon Okudara:LRB may have reported on this. CM Gabe Johnson:Federal employees have paid family leave,polling shows it is popular across the board and we need to be competitive with the private sector. CM Kimball: Fully agree, question is whether we can engage in this as the counties. iii. Honolulu City and County Resolution No. 23-231 RELATING TO THE INCLUSION OF A PROPOSAL IN THE 2024 HAWAI`I STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE TO AFFIRM THE AUTHORITY OF COUNTIES TO REGULATE THE SALE OF TOBACCO PRODUCTS AND ELECTRONIC SMOKING DEVICES. Measure approved. iv. Legislation related to supporting efforts to legally sell or donate wild-caught ungulate meat including, but not limited to, increasing meat inspectors on rural islands, 3. Legislation related to supporting additional pathways for midwifery licensure and legalization of traditional midwifery, 4. Legislation related to supporting extended producer responsibility with regards to solid waste, 5. Legislation related to increasing the number of mental health service providers for children and adolescents in rural counties, 6. Legislation related to financing residential cesspool conversions, 7. Legislation related to insurance coverage concerns for Hawai`i communities, especially those located in Lava Zones 1 and 2, 8. Legislation related to insurance coverage concerns for Hawai`i communities impacted by natural disasters including wildfires, hurricanes, and flooding, 9. Legislation related to effectively mitigating and managing invasive species to safeguard ecosystems, agriculture, and public health and safety. County of Hawai`i CM Kimball: Putting the building permits on a 6 year adoption, 6 years for building permits to be completed. hoping this resolves ambiguity on getting projects passed and completed in the time. Working with affordable managing projects within the county. hoping as affordable housing projects are developed, they will adopt this as well to help local residents with affordable housing package. HSAC package has been signed and passed, also passed a bill waving the professional engineer stamp for new installations with less than 10KW, continuing to work on a short term rental bill introduced in Jan. Sunsetting bed and breakfast program will be covered under the TAR bill. Making AD Us easier to build but not to be short term rentals. ii. County of Kaua`i CM Carvalho: Passed the real prop tax bill for tax reform. Increase of playing fees at Wailua golf course. More cost for more procurement and auditing cost. Approved HSAC legislative package. Still working on the real property bill. iii. County of Maui CM Paltin: Passed the HSAC leg package yesterday. Had the CNHA conference on Maui, the pre-first day was all about Lahaina. Passed out of committee a bill regarding taxes in the burn zone to give exemptions waving the min tax, especially for owner occupied and long term rentals which a lot of them are inaccessible. Dep of Finance looking at creating a special STR rate for folks if they give a 6 month lease to displaced residents. Many hotels do not want to renew contracts beyond the end of the month. Only hotel accepting pets is in Kahaluu. Community started fishing for housing in front of the resorts because there was no housing for 6800 people. Pushing for the governor to sign a moratorium on short term rentals, CM Fenrandez-Rawlins introduced a bill on short term rentals. Update on those who died and those still unidentified. Working on hazardous waste landfill, asking for $5M in permitting, planning and design. Kula began debris removal, taking them to central Maui landfill. Update on programs and resources available. Not sure what resources are available beyond February for the displaced individuals. Further discussion on landfill options and concern over the chemical composition of the ash. iv. City and County of Honolulu CM Waters:Passed the HSAC legislative report. All reports approved and received. c. WIR Report CM Sue Lee Loy: Fed gov working on a rule change, starting to embrace a uniform form change, this will be upcoming in the NACo conference. Attended CSAC recently, especially in regard to disaster response. Especially with insurance companies, who leave after a natural disaster. Federal legislation pending to see how much that insurance can expand to make sure people are covered. e. Executive Director Report ED Nahelani Parsons: Building out the website for future corporate sponsorship. PFAS presentation pending, did not receive many RSVPs for the one that was scheduled, encourage HSAC EC to connect directly. Future presentation on AI from a NACo vendor who could present in the future. Inquiry on the 501(c)(3) versus (c)(6). Clarification needed on HSAC reimbursement, does nto include HSAC conference but does include the HSAC EC meeting as either one day visit or one overnight. Pending NACo reimbursement for NACo CEO and Vice President. Upcoming plan for DC legislative breakfast. Need support in connecting with your local vendors. Executive Director Report November 21, 2023 Last report was given on October 26, 2023. The following is a summary of the work being conducted by the Executive Director. Reminders • Coordinate the Pearl Harbor tour suggested by CM Tyler Dos-Santos Tam. • Working on building out the website to include info on HSAC members'roles with NACo committees and awards that they receive. • Looking into a corporate sponsor program, including sponsors for the HSAC website, follow up on asking OCS for advice. • Pending presentations from Customs and Border Protection. • Discussion on 501(c)(3) versus 501(c)(6). • Will be doing a quarterly review (December) of the budget and sharing with the HSAC EC on where we are with our projected vs. actual spending. • Clarify the reimbursement for the HSAC annual conference versus HSAC EC meetings. • Planning and organizing the breakfast at the NACo legislative conference in D.C., February 2024. 1. Secretary Support: o Meetings with the Secretary's team to review and plan updates to the website. o Drafted agenda for the upcoming HSAC EC meeting. o Sent out reminders about the next HSAC EC meeting. o Website updates included reformatting the minutes and agendas page to be more accessible. Treasurer Support: o Working with the Treasurer and staff to update the signature cards so we can request bank statements from 2015-2019. Need to remove former Treasurer, Tommy Waters and former President Mason Chock from the signature card. o Following up with the accountant from Carbonara on the 2019 discrepancy, they requested bank statements from 2015-2019 in order to resolve a lump sum adjustment. o Audit-Brian Van Camp has been confirmed. They will begin the audit once they receive the report from the Carbonara accountant.. No agreement has been signed yet, as they will wait until we are ready to begin to send it over as a third of the payment for services will be due at that time. o Reviewed the Treasurer's report. o Maintenance of HSAC QuickBooks records. Completed reconciliation of last month's transactions in Quickbooks. o Processed reimbursements and invoices and uploaded documentation to the HSAC google drive as well as sent out copies of the documentation to the HSAC President. o Following up with our accountant, Carbonara &Associates to provide support in resolving the 2019 Quickbooks reconciliations. o Followed up on D&O insurance from: • King&Neel LLC, sean.spencer(d kin2neel.com 2. Fundraising Plan o ED attended the National Council of County Association Executives (NCCAE) October 24-26 to learn more about how other associations generate revenue and to network with other executive directors to strengthen the relationships with other associations that will benefit HSAC going forward. o Building out the website is the key initial step in developing a corporate partnership program. Meetings to be scheduled with other state associations to review their websites and learn more about how they structure their programs. o Reviewing options for a conference booklet which will help generate revenue. o Inquiring with other associations on potential grant funding opportunities. o ED drafted a corporate partner outline, once the meetings with other states have been conducted, will submit this to the EC for review and consideration. Conference Update: o Conference debrief and planning meeting conducted on October 20, 2023. o ED has started a conference guidebook containing a timeline of events and key elements that need to be planned out. CM Kimball: Request to circulate draft letter requesting support for breakfast including EIN. ED report approved and received. f. Legislative Report Jon Okudara: Going to start working on testimony drafts and also reaching out to legislators. CM Kimball: Talked to transportation chairs about the traffic bill. CM Paltin: Inquiry if there is any updated info on the family leave bill from LRB? Jon Okudara:Looking into this, the administration will say that there is a cost. Legislative report received. V. Treasurers report received. b. County Reports: i. County of Hawaii CM Kimball:Discussion on long term rental tax benefit. already have affordable tax benefit, rate is same as homeowners rate as well as 3% cap. long term rental rate would be for those renting for 10 months or more, would be tax benefit of homeowners rate plus 25%. Being sued by Earthjustice for a treatment plant that has settling ponds, potential reaching groundwater and getting out to the ocean. Corp counsel has requested special counsel. Basing numbers off Maui, could be a $7M loss for the counties. Other areas like adjustment to ag tax classes would bring an increase. Goal to incentivize long-term rental over short term rental. At the next conference, want to continue talking about tax incentives. ii. County of Kauai CM Carvalho: Bill 2910 recovery of rescue expenses, reimbursement, enforcement of the law Search and rescue and wildfires donation account to accept voluntary monetary contributions for search and rescue for wildfires. Part of recovery and rescue conversation. iii. County of Maui CM Paltin: passed resolution to take action on moratorium in gap from the bill in the HSAC package. Urging Gov to act through the emergency proclamation until the bill is available to be passed. To prevent mortgage foreclosure in the burn area. Army Corp of Engineer working on temp disposal site. Debris removal to be beg to late Jan. Community has concerns. Discussion on the debris removal process and updates. County looking at modular housing. Ohana assisted pilot program to build ADU to rent to someone for workforce housing. Looking to improve the permitting process. Concern if ash gets in to the water it will impact the water. Also trying to cap the entry points from the homes that burnt down. Passed a bill for subdivision of historical sites. Approved financing mechanisms for low income housing. Met with CNHA for community land trust. Iver 2000 sites to be cleared. A lot of the roads will be in even more disrepair after the debris removal, will need to remove the asphalt and repair. Have not yet done a comprehensive assessment on sewer lines. Some of the properties had cesspool, looking to if can upgrade to septic or if can sewer the area. Conversation about rebuilding the sea walls. Further discussion on the restoration of the burn zone. Some of the homes in the burn zone are still standing, most of them with water and power people are living here. Some are inaccessible due to it being in the middle of a burn area. iv. City and County of Honolulu Secretary Waters: Discussion on the Governors proclamation on housing, it allows development to go through DPP directly and not the council.
