Re: Acquisition of Property of Waiea Transfer Station
Enclosed is a resolution authorizing the acquisition of private property by eminent
domain of Tax Map Key Number(3) 8-6-008:011 for continued use as a solid waste
recycling and transfer station.
Since this resolution requests authorization to purchase Waiea Transfer Station through a
condemnation action, due to title defects affecting the property, the Department of
Environmental Management requests that this resolution be waived from Finance
Committee and be placed on the May 15, 2024 Council agenda. If there are any

A. REQUEST:
The Department of Environmental Management ("DEM") requests the placement of the attached draft
resolution on the May 15, 2024 Council agenda,waiving Committee, The attached draft resolution requests
authorization to purchase the Waiea Transfer Station through a condemnation action, due to title defects
affecting the property,
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Purchase of the Waiea Transfer Station site TMK No. (3)8-6-008:011 is an integral part of the Department's
plans. Funds equivalent to the fair market value of the property were included in the budget of the current
fiscal yeaati0T_he department obtained an independent appraisal of the property, which is valued at Two
Hundrectan o y-thven Dollars ($247,000.00). Negotiations were initiated with one of the owners of the
property, but there are other owners of record, who cannot be located. The real estate broker representing
one of the owners recommended purchase via a quit claim'deed. This is not an acceptable risk for the
county. Initiating a condemnation action in accordance with Section 101-26 Hawai'i Revised Statutes will
ensure that the County obtains clear title. County Council approval is required to initiate a condemnation
action. Time is of the essence to ensure that DEM does not lose the allocated funds.

KONA, COUNTY AND STATE OF HAWAI`I,FOR CONTINUED USE OF THE
WAIEA CONVENIENCE CENTER BY THE SOLID WASTE DIVISION OF THE
DEPARTMENT OF ENVIRONMENTAL MANAGEMENT.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i,this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Legislative Approvals and Acquisitions to the full Council for
immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter be placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, I understand the
matter shall be referred to the Committee on Legislative Approvals and Acquisitions for
placement on its future agenda.
