SUBJECT: Proposed Amendment to Bill No. 138; AN ORDINANCE AMENDING
CHAPTER 2, ARTICLE 7, OF THE HAWAI`I COUNTY CODE 1983
(2016 EDITION, AS AMENDED), RELATING TO PLANNING.
Transmitted herewith is.a proposed amendment to Bill No. 138. The amendment is shown below
in Ramseyer format with respect to the contents of Bill No. 138; material to be deleted is
bracketed and stricken, and material to be inserted is underscored.
SECTION 1 of Bill No. 138, which amends chapter 2, article 7 of the Hawaii County Code
1983 (2016 Edition, as amended), by adding a new section, is amended to read as follows:
"Section 2 Semiannual reports.
(a) The planning director shall provide reports to the council relating to the [Bz,etivities
A actions taken by the planning director for each six-month period from January
through June and July through December of each year. Reports shall be submitted
to the council within thirty calendar days following the end of each six-month
period.
(b) Each report shall include any property for which:
[(2)](ij An initial time extension has been granted[;] by the planning director;
[(3)](2) Applications have been approved for zoning variances, subdivision
variances, subdivisions, ohana dwelling permits, nonsignificant zoning
changes, plan approvals of telecommunications antennas, or additional farm
dwelling agreements; or
[(-4)]M [The planning direeter has the sole authority to grant the right to build.]
Any application, except for registration of a short-term vacation rental, has
been approved under the sole authority of the planning director, or approved
by operation of applicable law when the plannin director failed to apProve or
deny the application.

(c) Each report shall contain:
(1) The tax map key(s) for each property;
(2) The property zoning district at the time of the application;

[(6) The name of the agent or representative responsible for the applieutien, i

[(7) A statement indicating if the approval was granted as the result of the failure

which the variance is sought;

district resulting from the nonsignificant zoning change;

if the director has not set a date of expiration, the report shall so indicate;

application, if applicable; and

Due to the limited scope of these amendments, a copy of the new draft of this bill that will result
if these proposed amendments are adopted is not attached.
