Your Committee on Legislative Approvals and Acquisitions, to which was referred Resolution
No. 518-24, reports as follows:
Resolution No. 518-24, transmitted by Finance Director Diane Nakagawa, via Communication
No. 875, dated April 26, 2024, authorizes the acquisition of private properties by eminent domain,
being portions of Tax Map Keys: 1-4-001:002 and 1-4-001:003, situated at Kapoho, Puna, County and
State of Hawai`i, for the reconstruction of lava inundated roads, County Job Number E-4523,
specifically Pohoiki Road.
Authorizes the Corporation Counsel to initiate proceedings in eminent domain for the taking,
acquisition, and condemnation of private property for the purpose of widening Pohoiki Road to
comply with current roadway standards.
Deputy Corporation Counsel Sinclair Salas-Ferguson, Public Works Director Steve Pause and Public
Works Engineering Chief Alan Keone Thompson, were available for questions. Mr. Pause stated that
a contract was recently issued with Isemoto Contracting to begin construction and that this particular
portion of work would be for the Pohoiki Road restoration. Mr. Pause also stated this is a
condemnation for two properties, which are adjacent to Pohoiki Road and is necessary to complete the
widening of the road. The owners expressed reluctance to work out land deals with the County.
Mr. Pause explained that this is to take the minimal amount of land necessary, being an area of.577
acres and .365 acres, to continue with the design of the road.
Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent of
Resolution No. 518-24, and recommends its adoption.
