Date�&- 5 206 Community Development Plan ("CDP") Action Committees Eligibility Hawaii County Code ("HCC") Section 16-4 (Attachment A) defines the purpose of a community development plan action committee (CDP). Per § 16-4(b) The purpose of the CDP action committee is to be a proactive, community -based steivar d of the plan s implementation and update. Section 16-4(c) of the code states that the CDP action committees are to be administered by the planning department, The planning department is responsible for developing a selection process for committee members and establishing rules of procedure, as needed. Section 16-5 of the HCC addresses membership and tenure. A CDP action committee consists of nine members. Section 16-5(a) states All members shall have a primary residence in the area covered by the CDP. The members shall be appointed by the mayor and approved by the County council. Section 16-5(c) further states: The membership should reflect a broad cross-section of the community. The community development plan may specify more detailed selection criteria consistent with this objective. The Section 16-5(a) requirement that all CDP action committee members have a primary residence in the area covered by the CDP is the sole residency requirement for action committee membership. The HCC does not define "primary residence" in this context. During the adoption of this section of the County Code, the Council Chair proposed a change in this provision from "shall be permanent residents of to "shall have a primary r esidence in," thus making the residency requirement less stringent than originally proposed. (See Communication 1201.2 dated June 3, 2008 from then Council Chair Pete Hoffman (Attachment B)) This is consistent with the rationale provided to the County Council by the Planning Director during the establishment process for the CDP action committees. Director Yuen emphasized that the "Committee membership terms and broad selection criteria are spelled out providing flexibility for the individual CDPs to further define." (See Communication 1201 dated April 15, 2008 from Chris Yuen, Planning Director (Attachment C)) There is no indication that the Council or the Planning Director intended that the "principal residence" definition found in the Real Property Tax section of the HCC have any relevance to the residency requirement for CDP action committee members. Application of such a strictly defined term would be inconsistent with the apparent intent of the drafters to maintain flexibility. Our office has been informed that the Planning Department has a review process for CDP action committees. The application process, including the form, is the same as for any board or commission, but applicants for CDP action committees are forwarded to the Planning Department for review of all relevant information, including residence. The Planning Department conducts interviews with the applicants. In the case of Mr. Yokoyama, he was asked where he lived, and he told Planning Department Staff that he lived in Ka'u. He also informed Planning Department Staff that he had a business located in San Diego, and spent time there. The Planning Page 1 Department, after considering Mr. Yokoyama's application, sent it to the mayor's office with a favorable recommendation. From Mr. Yokoyama's previous presentation, he regards his family home in Pahala as his house, articulates a strong connection to his community of birth, and a commitment to serve his community. In accordance with the expressed intention of the legislation for Bill 297 which created Articles 2 and 3, Chapter 16 of the HCC, Mr. Yokoyama can be considered to meet the eligibility criteria for Ka'u CDP membership. The County of Hawai'i general plan. (a) That certain planning code known and designated as "County of Hawaii general plan," as adopted on December 5, 1971, by the council of the County of Hawaii, is hereby adopted by reference, subject to later amendments by ordinance, and may be cited as the "general plan." (b) A copy of the general plan and amendments shall be available for public inspection at the planning department. The document identified as "HAm5kua Community Development Plan" is adopted by reference, subject to later amendments by ordinance, and may be cited as the "Hamakua CDP," The planning area for the Hamakua CDP encompasses the Judicial District of Hamakua, North Hilo, and a portion of the South Hilo District in the County of Hawai'i. KA'U. The document identified as "Ka'u Community. Development Plan" is adopted by reference, subject to later amendments by ordinance, and may be cited as the "Ka'u CDP." The planning area for the Ka'u CDP encompasses most of Judicial District 9 in the County of Hawaii. Eastern portions of the district near and including Volcano Village were included in the Puna CDP planning area and were, therefore, not incorporated into the Ka% CDP. KONA. The document identified as "Mapping the Future- Kona Community Development Plan Volume 1" is adopted by reference subject to later amendments by ordinance, and may be cited as the "Kona CDP." The planning area for the Kona CDP encompasses the judicial districts of North and South Kona. NORTH KOHALA. The document identified as "North Kohala Community Development Plan" is adopted by reference subject to later amendments by ordinance, and may be cited as the "North Kohala CDP." The planning area for the North Kohala CDP encompasses the judicial district of North Kohala. (c) The planning department shall administer the CDP action committees and be responsible for developing a selection process for committee members and establishing rules of procedure, as needed. (2008, ord 08-98, sec 4.) Section 16-5. Membership and tenure. (a) The CDP action committee shall consist of nine members. All members shall have a primary residence in the area covered by the CDP. The members shall be appointed by the mayor and approved by the County council. Prior service as a member of a CDP steering committee shall not disqualify an individual from serving on the CDP action committee. (b) The members shall serve staggered terms of four years. Upon the initial appointment of the committee, three members shall serve for a term of two years, three members for a term of three years, and three members for a term of four years. When the term of a member expires, the member may, at the discretion of the member, continue to serve until a successor is appointed. Members whose terms expire may not be reappointed for at least two years, however, members appointed for one year or less may be reappointed for an additional term without the passage of two years' time. Existing vacant positions shall be filled before filling any position occupied by a member whose term has expired but who is willing to continue serving until their position is filled. (c) The membership should reflect a broad cross-section of the community. The community development plan may specify more detailed selection criteria consistent with this objective. (d) A chairperson shall be elected from its membership annually. (e) Except as provided for in this section, the committee shall be governed by the County Charter, section 13-4. The duties and responsibilities of the committee are: (1) Provide ongoing guidance and advocacy to advance implementation of the CDP goals, objectives, policies, and actions; (2) Broaden community awareness of the CDP and build partnerships, as appropriate, with governmental and community -based organizations to implement CDP policies and actions; (3) Take into consideration statewide objectives and legislation for long-term and sustainable plans for the island as a whole; (4) Provide timely recommendations to the County on priorities relating to the County operational budget and the CIP budget and program; (6) Receive briefings, as requested, from the planning department on pending and approved permit applications involving property located within the planning area, and on other issues related to the CDP; (6) Receive briefings from other County agencies, as requested, on priority actions identified in the CDP, which briefings may be integrated and consolidated by the mayor's office or the planning department into a plan of action for the forthcoming year and a status report on the current year's plan of action; (7) Monitor the progress and effectiveness of the CDP including the need for CDP revisions based on emerging statewide plans, new technologies, innovative ideas, or changing conditions; (8) Review and make recommendations on interim amendments to the CDP; (9) Serve as the steering committee, as set forth in the general plan, in any comprehensive update of the CDP; (10) Provide recommendations to amend the general plan; and (11) Carry out other duties specified in the CDP and/or in agreement with the planning department. Bill 297 amends Chapter 16, Hawai`i County Code 1983 (2005 Edition, as amended), Planning, by incorporating provisions to establish a framework to adopt and amend the Community Development Plans (CDP) and also to establish CDP Action Committees . The proposed amendments intend to clarify certain aspects of the CDP Action Committee's role and responsibilities as well as correct minor wording as agreed with the Department of Planning. The proposed amendments are illustrated via Ramseyer format with respect to the contents of Bill 297, bolded for illustrative purposes, and reads as follows: Amend SECTION 1 to read as follows: "SECTION 1. Purpose. Bolding has been retained for illustrative purposes. Last, the language that has been proposed for addition to chapter 16 (contained within SECTIONS 3 and 4 of Bill 297) has been underlined to clearly indicate amendment to the County Code. As you know we are in the process of wrapping up the draft CDPs for Puna, Kona and Kohala so it is timely that we address the question of who and how the community will remain involved in the implementation of the plans. We appreciate you initiating the effort with a draft ordinance proposal (dated February 5, 2008) after conversations with me and other staff. Since that time we have conferred with our staff, the mayor's office, Research & Development staff and others currently involved in the CDP to obtain feedback since they will be ultimately responsible for supporting whatever community CAP implementation entity is fornted. After considerable deliberation and discussion, we have drafted an ordinance proposal which is attached for your consideration. Below we have listed the key elements of our proposal and the rationale behind it. 1. Ordinance amends Chapter 16,'1'he Hawai'i County General Plan as the CDPs are "short and middle range" plans that further define the broader goals of the General Plan. The key focus is advisory oversight and advocacy - providing guidance, community awareness, and partnering with County government and community -based organizations rather than regulatory. This was arrived at after considerable debate. We did not want the Action Committee to duplicate existing regulatory review such as Planning Commission and Hoard of Appeals. To make the Action Committee review land use applications that go to the Planning Commission would create a duplicative layer of government. The Committee will monitor the effectiveness and progress of CDP implementation and provide recommendations on the County CIP and operating budgets: They will also be the community entity to provide input on CDP and GP amendments and updates.
