SUBJECT: County Council Initiated Bill No. 123 (PL-CCI-2024-000005)
Amendment to Chapter 19,Article 1 and Article 13, Chapter 23,Article 9,and
Chapter 25,Article 1,Article 2,Article 5,and Article 6 of the Hawaii County
Code 1983 (2016 Edition,As Amended)Relating to Ohana Dwelling Units
The Windward Planning Commission (Commission), at its duly held continued public hearing on
May 2, 2024, considered the County Council Initiated Bill No. 123, amending Chapter 19, Article 1
and Article 13, Chapter 23, Article 9, and Chapter 25, Article 1, Article 2, Article 5, and Article 6 of
the Hawaii County Code 1983 (2016 Edition, as Amended) relating to `ohana dwelling units.
Although this bill was on the Commission's April 4, 2024 regular meeting agenda and May 2, 2024
continued meeting agenda,the Commission was not able to hear the matter due to a lack of quorum.
Section 25-2-43(b) indicates that the Commission has 120 days to provide a recommendation to the
County Council from the date the bill is transmitted to the Planning Director. If the Commission fails
to act in that period of time, such inaction shall be considered as an unfavorable recommendation by
the Commission.
Since the Commission failed to act by May 29, 2024, an unfavorable recommendation of Bill No.
123 is being provided to the County Council.

Code 1983 (2016 Edition,As Amended)Relating to `Ghana Dwelling Units
The Leeward Planning Commission, at its duly held continued public hearing on May 22, 2024,
considered the County Council Initiated Bill No. 123, amending Chapter 19, Article 1 and Article 13,
Chapter 23, Article 9, and Chapter 25, Article 1, Article 2, Article 5, and Article 6 of the Hawai`i
County Code 1983 (2016 Edition, as Amended)relating to ohana dwelling units.
The Commission voted to forward a favorable recommendation of Bill No. 123 to the County
Council based on the Planning Director's recommendation as follows:
Recommendation#1:
Under Section 25-2-3(a), consider removing the reference of"ohana dwelling permit".
Recommendation#2:
Section 25-5-27(c) should identify that an accessory dwelling unit shall be located within the RD
zoning district by stating the following: "An accessory dwelling unit may be located on any building
site in the RD district, as permitted under article 6, division 3 of this chapter."
Recommendation#3:
Section 25-6-32(3) restricts accessory dwelling units from being built on building sites that have a
transient accommodation rental. Consider removing this restriction.
