RESOLUTION NO. 537 24
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A
LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR
A MULTI-YEAR LEASE OF REAL PROPERTY FOR THE COUNTY OF
HAWAI`I IN KEA`AU, DISTRICT OF PUNA.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or
other obligation requiring payment of funds from the appropriations of a later fiscal year or of
more than one fiscal year be approved by resolution; and
WHEREAS,the County of Hawai`i desires to lease approximately 800 square feet of a
warehouse situated in Kea'au, County and State of Hawai`i, from Milo Storage, LLC
("Landlord") for various County departments and agencies to utilize as an additional storage
area; and
WHEREAS,the County of Hawaii desires to enter into a multi-year lease agreement
which is anticipated to commence on July 1, 2024, for a five-year term, with the option to renew
the lease for two (2) additional five (5)year terms with Landlord; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I that the
Honorable Mitchell Roth, Mayor of the County of Hawai`i, is hereby authorized to enter into a
multi-year lease with Milo Storage, LLC, for a five-year term with options as indicated above.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years
to cover the anticipated obligations of the County under the terms of the amended Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this
resolution to: (1) Mayor Mitchell Roth and(2)the Department of Finance.
