AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 7, OF THE HAWAVI COUNTY
CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO PLANNING.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAFI:
SECTION 1. Chapter 2, article 7 of the Hawaii County Code 1983 (2016 Edition, as
amended) is amended by adding a new section to be appropriately designated and to read as
follows:
"Section 2- . Semiannual reports.
(a) The nlannina director shall provide reports to the council relating to the actions
taken by the..planniniz director for each six-month period from Januai throe h June
and July through December of each year. Reports shall be submitted to the council
within thirty calendar days following the end of each six-month period.
(b) Each report shall include any property for which:
(1) An initial time extension has been granted by the planning director;
(2) Applications have been approved or denied for zoning variances, subdivision
variances, subdivisions, ohana dwelling_ permits, nonsignificant zoning
changes, lap a rovals of telecommunications antennas or additional farm
dwelling agreements; or
(3) Any application, except for registration of a short-term vacation rental, has
been approved or denied under the sole authority of the planning director or
by operation of applicable law when the planning director failed to approve or
den,• t�pplication.
(c) Each report shall contain:

2 The propetty zoning district at the time of the application;
(3) In the case of variances, the provision(s) of chapter 23 or chapter 25, for
which the variance is sought;
4) In the case of nonsignificant zoning chance applications, the new zonin
district resulting from the nonsignificant zoning change,
(5) The date of expiration for the approval of the application, if applicable; or, if
the director has not set a date of expiration, the report shall so indicate; and
6 The conditions imposed by the director as a condition of a roval of the
application, if applicable,"
SECTION 2. New inaferial is underscored. In printing this ordinance, the underscoring
need not be included.
SECTION 3. Severabilily. Ifany provision of This ordinance, or the application thereof
to any person or circunistalice, is held invalid, the invalidity does not affect other provisions or
applications of the ordinance which Can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable.
SECTION 4. This ordinance shall take eflect oil July 31, 2024.
